BC <br /> <br />))QlSe control, solid waste disposal, ~sticide regulation, radiation <br />crJ!eria and standards, or other matters-v/itfiin its authority. - <br /> <br />(3) A period of not less than 45 days will normally be est3.blished for reply, <br />after which it may be presumed, unless an extension is requested, that <br />the agency consulted has no comment. Whenever feasible, e~tensions <br />of time of up to 15 days should be granted. In e:<ceptional cases, ~ <br />time is critical, a review time limit of 30 days may be established. A <br />period of 45 days shall be allowed for EPA review. The r~view period ," <br />will officially start on the date the Notice of Availability is published in <br />the Federal R~g.ister. <br /> <br />C. State and Local Agencies. <br /> <br />(1) Where no public hearing was held to invite State and local review, and <br />where review of the proposed action by State and local agencies author- <br />ized to develop and enforce environmental standards is relevant, State <br />and local review shall be provided as folloVJs: <br /> <br />. <br /> <br />(a) For Federal water and related land resources plans, projects, and <br />programs, review by State and local governments will be through <br />procedures set forth by the Water Resources Council (Section IDE <br />of Policies, Standards, and Procedures in the Formulation, Eval- <br />uation, and Review of Plans for Use and Development of Water and <br />Related Land Resources, approved by the President on May 15, <br />1903, and printed as Senate Document 97, 87th Congress; Handbook <br />for Coordination of Planning Studies and Reports, June 1909). <br /> <br />(b) For direct Federal development projects, including water and <br />relateclland resource projects, and for projects assisted under <br />programs listed in Attachment D of Office of Management and <br />Budget C)rcular_A-95, review by State and local governments <br />will be through State and Regional or Metropolitan Clearinghouses <br />in accordance with Circular A-95 and implementing Bureau <br />instructions. <br /> <br />(c) For actions affecting the cultural or historic components of the <br />environment, review by State and local agencies will be through <br />procedures set forth by the Advisory Council on Historic Preser- <br />vation (36 F. R. 3310), and draft environmental statements will <br />reflect consultations with the State Liaison Officer for Historic <br />Preservation and with the State Archeologist. <br /> <br />(d) For actions having an impact on Indian lands or communities, <br />review by State and local agencies will also include review by <br />local Indian tribal governing bodies. <br /> <br />(2) Where the procedures in CO) above are not appropriate, review and <br />comment by State and local agencies authorized to develop and enforce <br />environmental standards may be obtained by distributing the draft <br />environmental statement to the appropriate State and Regional or <br />Metropolitan Clearinghouses, unless the Governor of the State has <br />designated some other point for obtaining this review. <br /> <br />. <br /> <br />370-4 - 1/12/72 <br /> <br />0228 <br />
