<br />34(~';' <br />j;,\j <br /> <br />October 29, 1982 <br />Page 2 <br /> <br />of jurisdiction on the part of Eagle County over matters occurring at <br />Colorado Springs and Aurora which are within their Home Rule powers. <br /> <br />The Cities' interpretation of "source development area" and "development <br />area" is consistent with the interpretation by the Eagle County Attor- <br />ney's office. <br /> <br />Because detailed engineering plans, per ~304(5)(a) and (1) have not been <br />prepared prior to completion of permit approvals, the Cities are sub- <br />mitting general engineering plans which are sufficient for permit review <br />purposes. After approval of this permit application, detailed engineer- <br />ing plans will be prepared and submitted to the County for use during <br />construction. <br /> <br />Submittal of this application is pursuant to C.R.S. '73, ~26-65.1-101, <br />~ seq., (Supp.1981) and also fulfills the requirements of C.R.S.. '73, <br />~30-28-110 . <br /> <br />A brief review, as follows, of the criteria for approval of a major <br />extension of an existing water system demonstrates that the project <br />meets all the criteria and must be approved: <br /> <br />4-306(1) <br /> <br />a) The Homestake Phase II water collection project will have <br />minimal and remote environmental impact within the Holy Cross <br />Wilderness Area. The financial impact will largely be limited <br />to the Leadville area where construction employees are <br />expected to be housed. The financial impact in that <br />community, compared to present conditions, in that community <br />are likely to be a benefit. In terms of Colorado Springs and <br />Aurora, no adverse environmental impact directly related to <br />the provision of water will occur. Air pollution as an <br />indirect impact (if any), is expected to remain within <br />National Ambient Air Quality Standards, even after this new <br />water supply is available to accommodate growth. Both <br />communities have the financial capability to fund the project <br />through bonds paid with revenues from system development <br />charges on new users and rate payers. <br /> <br />b) This project does not conflict with Eagle County's Master <br />Plan, nor the NWCOG 208 plan. Colorado does not have a state <br />water plan nor does it have a land use plan. There is no <br />Federal water plan and the project is consistent with Federal <br />land use plans, policies, and law. <br /> <br />c) <br /> <br />This project does <br />rights nor junior <br />development area. <br /> <br />not adversely <br />surface water <br />There are no <br /> <br />affect senior surface water <br />rights within the source <br />subsurface water rights in the <br /> <br />, <br />
