Box 850 <br />Eagle, Colorado 81631 <br /> <br />Re: Application for Approval of Homestake Phase II <br />Water Project Pursuant to Eagle County Resolu- <br />tion No. 80-25, Chapters 4 and 5. <br /> <br />Dear Sirs: <br /> <br />Enclosed is a single application for approval of the Homestake Phase II <br />Water Project as a Major Extension of an Existing Domestic Water Treat- <br />ment System and an Efficient Utilization of Municipal and Industrial <br />Water Projects. This application is not on the Colorado Land Use <br />Commission applieation form, because the complexity of the project <br />requires greater response to the submission requirements than the <br />Colorado Land Use Commission form allows. <br /> <br />The Application with attachments is intended to be a complete document. <br />Attachment 1 is the Draft Environmental Impact Statement. The final EIS <br />is being prepared and may be distributed by the Forest Service prior to <br />a decision by you on this application. Should it become available, the <br />cities will present copies to the Board to supplement this application; <br /> <br />Comments on this proposal by the Colorado Department of Natural Re- <br />sources and the Colorado Department of Health will be forwarded to you <br />as soon as possible. Copies of this application are being mailed to <br />them simultaneously with this mailing to you. <br /> <br />In preparing this application, the Cities interpreted the phrase "source <br />development area" as meaning the project area within the Holy Cross <br />Wilderness on the Homestake Creek, Fall Creek, and Cross Creek drain- <br />ages. Accordingly, the emphasis upon impacts attributable to this <br />project is upon impacts within the Forest Service lands. <br /> <br />The "development area" has been interpreted to mean the urban areas of <br />Colorado Springs and Aurora areas. While the Cities do not intend to be <br />offensive, the Cities sincerely question whether Eagle County has juris- <br />diction over matters occurring wholely within the Cities' corporate <br />boundaries. Accordingly, the Cities must respectfully assert this lack <br /> <br />.;,.<,,1 <br />
