<br />, , <br /> <br />3423 <br /> <br />( ., ( :P <br />for existing and future needs of the residents of the County shall <br /> <br />be considered in determining \'Ihether an "undue financial burden" <br /> <br />~,;ll result; <br /> <br />(t) The development site of a proposed major extension of an <br />existing domestic water or sewage treatment system is not subject <br />to significant risk from earthquakes, floods, fires or other <br />disasters which could cause a system operational breakdown; <br /> <br />(u) Any proposed domestic water treatment and distribution <br />system is capable of providing water meeting the requirements of <br />the Colorado Department of Health. <br /> <br />(v) The construction of structures, buildings, and improvements <br />associated with the proposed development will not significantly impact <br />existing or proposed communities within the development area and source <br />development area. <br /> <br />(2) The permit shall be denied if the applicant fails to satisfy <br />all the criteria outlined in 4-306(1). <br /> <br />ARTI CLE 4 <br />ADMINISTRATION, ENFORW1ENT AND PENALTIES <br /> <br />4-401. Administration, Enforcement and Penalties. <br /> <br />The provisions of this regulation and any permits issued hereunder <br />shall be administered and enforced according to the provisions of the Adminis- <br />trative Regulations adopted by this County. <br /> <br />4-402. Severabil ity. <br /> <br />If any section, clause, provlslon, or portion of these regulations <br />should be found to be unconstitutional or otherwise invalid by a court of <br />competent jurisdiction, the remainder of this regulation shall not be affected <br />thereby and is hereby declared to be necessary for the pUblic health, safety <br />and \~elfare. <br /> <br />- 52 - <br />
