The fOllowing guidelines are proposed for negotiatin:l <br />scenic easements: <br /> <br />1. Scenic easements will not: <br /> <br />a. Give the public the right to enter upon the property <br />for any purpose. <br /> <br />b. Deny the right of the landolmer to use the area for <br />general crops, livestock farning, and p,ardening. <br /> <br />c. Affect any regular use exercised prior to the acquisi- <br />t ion of the easement without the OImer' 5 consent. <br /> <br />d. Affect the right of a landowner to sell his land or the <br />right of heirs to inherit the land. <br /> <br />e. Affect the right of the landOl-mer to perform uaintenance on <br />all existin(l roads, structures and buildings and the right <br />to replace, rebuild or substitute any road, bui1dinr- or <br />structure nOli existing Iii th sir.dlar roads, buildinfs or <br />structures in substantially the same locations. <br /> <br />2. Scenic easements will: <br /> <br />a. Exclude industrial activity except for prior established <br />uses. <br /> <br />.b. Require that the easement area be kept in a neat and <br />orderly condition with no ~arbage, trash, or other unsightly <br />material allowed to accumulate. <br /> <br />c. ltequire that the general topography he l.laintained in its <br />present condition unless changes are approved by the Forest <br />Service. <br /> <br />d. Prevent unattractive or nonpermanent structures from <br />beinc moved into the easement area. <br /> <br />9 <br />
