" . I....
\ t' ~.; _ h.
U....;".. ~ '."

August of 1973 for revocation of this power site. A year is usually required

for a revocation to be processed by the Federal Power Commission. The power

site would be located on the Lake Fork of the Los Pinos River and would utilize

the flow from Emerald Lake. The project would consist of an intake and a pen-

stock extending along Lake Fork to a power plant on Los Pinos River. The Federal

Power Commission reported in a letter to the Depa~tment of Agriculture concern-

ing the Weminuche Wilderness that there would be little likelihood of this site

being developed due to its remoteness from major electric load centers. After

a stream has been accepted into the Wild and Scenic Rivers System, the Federal

Power Commission is prohibited from licensing certain projects on or directly

affecting and components of the national system.
'i

WATER RIGIITS

There are currently only two decreed water rights existing on the portion

of the Los Pinos and its tributaries under consideration for inclusion in the

Wild and Scenic Rivers System. The Weminuche Pass Ditch is located on the Rincon

La V6ca tributary to Los Pinos and the Pine River Weminuche Pass Ditch is located

on the North Fork of Los Pinos. Both of these canals divert water into the Rio

Grande drainage basin. The Weminuche Pass Ditch has four separate decrees which

total 40 cfs. Priority dates and basin rank for the four decrees are shown below:

Amount Appropriation Date Basin Rank
6 Cfs. 7/28/1934 86
6 Cfs. 11/12/1934 89
8 Cfs. 8/24/1935 91
20 Cfs. 6/16/1950 105

The Pine River Weminuche Pass Ditch has three separate decrees totaling 18 cfs.

Priority dates and' basin rank are shown on the following chart.

-2-
