<br />~ <br />0> <br />C'.1 <br />o <br /> <br />CHAPTER V <br /> <br />STAGE TWO PLAN OF DEVELOPMENT <br /> <br />.:..".) <br /> <br />or informally organize to ensure the improved laterals would be adequately <br /> <br />and properly operated and maintained. <br /> <br />It is assumed that the Colorado <br /> <br />Division of Wildlife would administer any areas acquired for wildlife <br /> <br />habitat. <br /> <br />Conditions Precedent to Construction <br /> <br />Public Law 93-320 which authorized the Grand Valley Unit stipulates <br /> <br />that, "Prior to initiation of construction of the Grand Valley Unit, <br /> <br />the Secretary shall enter into contracts through which the agencies <br /> <br />owning, operating, and maintaining the water distribution systems in <br /> <br />Grand Valley, singly or in concert will assume all obiligations relating <br /> <br />to the continued operation and maintenance of the unit's facilities to <br /> <br />the end that the maximum reduction of salinity inflow to the Colorado <br /> <br />River will be achieved." Before construct ion of any increments of Stage <br /> <br />Two could begin, operation and maintenance agreements among all involved <br /> <br />entities would be required. <br /> <br />A large portion of the planned Stage Two development would involve <br /> <br />the Government Highline Canal and laterals necessitating a new contract <br /> <br />between the United States and the Grand Valley Water Users Association to <br /> <br />assure proper operation, maintenance, and replacement of the improved <br /> <br />facilities. <br /> <br />Contracts between the United States and each independent lateral <br /> <br />entity would be necessary to assure that operation, maintenance, and <br /> <br />replacement of the improved system would be conducted in such a manner <br /> <br />that the planned salinity reduct ion would occur. <br /> <br />Toward this purpose, <br /> <br />unincorporated lateral entities would need to be organized 80 as to <br /> <br />constitute legal contracting bodies. <br /> <br />46 <br />
