<br />.It was not up to us to decide that question.
<br />We were very carerul to see that this compact did not im'pede or
<br />prevent ruture beneticial development, if any can beaccomphshed in
<br />that basin; at the same time, being equally certain and detinite that
<br />the rights which were determined in this compact would not be upset,
<br />,or endangered by some other ruture development.
<br />It is- very necessary to recognize the position and the operations or
<br />the United States Army engineers in this picture." They built the
<br />reservoir. It is the responsibility or the Corps or Engineers to main-
<br />tain that reservoir and t ooperate the same. And, I am sure General
<br />Kramer will entirely to your satisfaction explain why that last provi-
<br />sion was put in that has been caned to the attention or this committee.
<br />It has been explained to you gentlement that we had more or less
<br />or a compact within a compact because or the location or this reser-
<br />voir and dam.
<br />It more or less temporarily upset or changed the relative rights and
<br />positions or the water users above the reservoir in Colorado and the
<br />water users below the reservoir in Colorado. But this compact also
<br />makes it possible now ror water users above the reservoir who here-
<br />torore were restricted to the use or that water based on priority or
<br />right to ignore senior rights .below which previously they could not
<br />,([0 if they had a junior decree.
<br />Now .when there is water in that reservoir, the direct flow water
<br />above the water reservoir is open andrree. It has been a great benefit
<br />to the water users above the reservoir. By the same token, a controlled
<br />storage is a greater benetit to the water users below the reservoir.
<br />Article VIII goes into detail as to how the reservoir will be operated
<br />'and by whom alter the compact has gone into effect. There will be
<br />a Federal representative ir the President sees fit to appoint one who
<br />will act as chairman without vote. Each State has one vote regard-
<br />less or the number on the commission. The jurisdiction or each State
<br />has been rully protected by article VIII.
<br />Another thing we were carerul about was to provide that this com-
<br />pact establishes no general principle or precedent. with respect to
<br />,any other interstate stream.
<br />I reel that we have adequately protected the rights and sovereignty
<br />or the United States in article IX because that provision was not only
<br />satisractory to the members or the commissions or the two States, but
<br />to all Federal agencies. . ,
<br />I believe, if it please the committee, that that is all I have to say,
<br />other than to add to Mr. Stone's remarks this statement : The help or
<br />General Kramer in working with us in resolving ou.r differences was
<br />very unusual and very tine. We deeply apprecmte the assistance he
<br />gave us.
