<br />I have only this to say about it: We believe that it is an appropriate
<br />provision. It should be recognized that John Martin Dam and Reser-
<br />voir is an Army engineer project, aIid it is necessary, of course, that
<br />the flood c.ontr.ol features of that pr.oject be adequately preserved and
<br />made effective through the administration of the reservoir and the
<br />use of water which arises from it. That was merely a means .of
<br />pr.ovidingfor protecting the prerogative .of the Army engineers in
<br />handling Army engineer fl.o.od c.ontrol pr.ojects while, at the same time,
<br />working .out a c.o.operative arrangement between the States and the
<br />Army for the utilizati.on of the c.onservati.on fel'tures of the pr.oject.
<br />The two States th.ought it was appropriate and we rec.ognized it
<br />was a provision that the Federal representative was justified in having
<br />included. .
<br />Mr. MILLER. I think it is a fine thing, Judge Stone, that y.ou are
<br />able t.o get these tw.o States together on a compact, and we are just
<br />hopeful that maybe Ariz.ona and Calif.ornia might profit by the ex-
<br />periences and the advances that y.ou f.olks have made in these tw.o
<br />things. ..'

<br />has. every major river rising in that State covered by camp act, except
<br />where the Supreme Court has entered a decree .on tw.o rivers,
<br />Mr. BARRETT. As I understand it, and as I understand the auth.or-.
<br />ity of the Army engineers .on the John Martin pr.oject, they have
<br />authority over the flo.od c.ontrol st.orage and the conservati.on p.o.ol as
<br />well under the pr.ovisi.ons .of this bill. And the fl.ood control as de-
<br />scribed is that p.orti.on .of the t.otal storage as all.ocated far fl.o.od c.ontr.ol
<br />purposes and the c.onservati.on is that st.orage .of the fl.ood c.ontr.ol
<br />st.orage, .
<br />Do I understand under the pr.ovisi.ons of this c.ompact, that the

<br />Mr. STONE. This J.ohn Martin Dam and Reservoir presents an in-.
<br />teresting thing which happened i.n 193$ in the authorization .of this
<br />pr.oject, and which pr.opably will not happen again. There is n.o
<br />requirement far repayment .of the cast of the conservati.on features .of
<br />J.ohn Martin Dam and Reserv.oir. The full cast is assumed as a
<br />Federal investment without any requirement far repayment of the
<br />cast of the conservation features,
<br />We' have had same rather interesting questions come up in ..our
<br />own State relative to this situation. I don't think it can happen again.
<br />Many pe.ople think it is possible under other reserv.oirs.
<br />Mr. BARRETT. Judge St.one, I am interested in the forepart of your
<br />statement, but the latter part .of it discourages me somewhat. I hoped
<br />that there might be a method. whereby some dams might be constructed
<br />in Wyoming on that same basis. You seem to discourage me.
<br />Mr. STONE. Well, it is rather discouraging, Congressman, but, from
<br />the point .of view I have, I thiIik it is right that conservation capacity
<br />should be paid for by the beneficiaries. I need not go into the reason
<br />it has happened in the John Martin Reservoir, h.owever, I c.ould state
<br />briefly that when this reservoir was first set up, it was understood that
