<br />. When the Supreme Court, in its last decision in December or
<br />reiterated rather emphatically its decision, acquired rrom expe
<br />in other interstate water suits on successive rivers, that the co
<br />provision or the United States Constitution was the proper m
<br />or settling these difficulties, and not litigation, we decided to
<br />And so the Commissioners and the Federal representative appro
<br />the matter, I believe, entiI:ely rrom the viewpoint or accomplish
<br />fair, equitable, and just composition or the controversies, and a
<br />ficial arrangement ror the development or the use or the wat
<br />volved in the controversy,
<br />. I think that while, in a sense, the various Commissioners repr
<br />ing their respective State's interest, and the Federal represen
<br />guarded very carerully the interest or the Federal Government
<br />all had the idea that the result would be attained, and to be att
<br />was to do the right thing in the interest or the public and in t
<br />terest or the two States, and I hope and reel that we have accomp
<br />. it. Speaking as a citizen, as a lawyer, and as a Commissioner
<br />haps the greatest advantages in this compact are the settlement an
<br />ending or the controversy. I think that has resulted in wh
<br />lawyers call quieting title, teIling us what we have and what we d
<br />have, what we can do and what w.e c,am,;ot do, and remoyin8' ?on
<br />threats and rears or harrassment, IrrItatIOn).. and I mean mdIvIdu
<br />ritation as between the residents or the two ;,;tates,
<br />We are rortunate in that the construction or theJ ohn. M
<br />Dam gave us a means or using water that hitherto was not ava
<br />ror beneficial use, and was also on occasions a threat by its v
<br />incursions.
<br />The basis or the compact, generally speaking, is a distributi
<br />the regulated flow out or the John Martin Reservoir by the two S
<br />on a proportion or 60-40, 60 percent ror Colorado, and 40 pe
<br />ror Kansas, The water, or course, all originates in the Sta
<br />Colorado, The river commences near LeadVIlle and flows abou
<br />miles to the State line between Colorado and Kansas, and 58
<br />above that line we have the John Martin Dam and Reservoir cr
<br />
<br />by 4ts reservoir provides 702,000 acre-reet capacity, or which 28
<br />reet are allocated ror flood protection purposes, and has a value, a
<br />value ror that purpose. In my own judgment, and in the judg
<br />or others, the principal value, or course, IS round in the conserv
<br />pool, the ca pacity left aIter allowing use ror flood protection. .
<br />The dam and reservoir are now completed. For the last 4
<br />it was in a sitnation where it could be partially operated, but with
<br />limited storage capacity, and under the direction or the Corp
<br />Engineers, who will continue to have direction over this opera
<br />
