<br />we were permitted to. store around 100,000 acre-feet, and we operated
<br />under a division between the two States by virtue of a so-called
<br />interim executive agreement between the Governors of the States of
<br />Kansas and Colorado. We found that operation quite satisfactory,
<br />and the experience derived from that operation has also helped to
<br />work out the hasis of the division, or the method of operation which
<br />we provide under the compact.
<br />We were careful to protect whatever right New Mexico might have
<br />in the water arising fr()m this Trinchera Creek, by saying we had
<br />not interest in it, and did not in any way dispose of it.
<br />We also guard the situation as to the possible future importation
<br />of water into the basin of the Arkansas, from the Colorado River, by
<br />providing that they were not covered by this compact and could not
<br />be-and the Colorado River compact between the Colorado Basin
<br />Stateshthat water cannot be used outside the States in the basin.
<br />Weave made a report to the Governor and to the Legislature of
<br />the State of Colorado, of which I think the chairman was furnished
<br />several copies, and I would. like to submit it in the form of an exhibit
<br />for the hearings before this committee, Mr. Chairman.

<br />There jEj', herewith submitted the Arkansas River Compact which was negow
<br />tinted and signed by the Oommissioners representing the States of Colorado
<br />and Kansas, and approved by the Federal representative on the 14th day
<br />of December, 19'48. This compact accomplishes two major purposes: (a) It
<br />, setUes existing d,lsputes and removes causes of future controversy between
<br />the two States, and betweel! the citizens of one State as against citizens
<br />of the other State concerning the waters of the Arkansas River as well as
<br />their control, conservation and use for irrigation and other beneficial pur~
<br />poses; (b') It equitably apportions between the two States the waters of
<br />the Arkansas River as well as the benefits arising from the construction,
<br />operation and 'maintenance by the United States of John Martin Reservoir
<br />fOl;- water cOllservation purpb-ses.
