(4) House Bill--Section 4(a) directs the Secretary to
complete the EIS within three years. rather than the
two years proposed by Reclamation. and further directs
what evaluations. at a minimum. shall be included in
the EIS.

Senate Bill--Section 5(a) contains the same directive
to the Secretary as does the ..House bill to complete
the EIS within three years. However. the Senate
bil~. unlike the House bill. does not direct what
evaluations shall be included in the EIS.

(5) House Bill--Section 4(b) directs the Secretary to
adopt new "long-term operating criteria" for Glen
Canyon Dam based upon the findings and conclusions of
the EIS. which new criteria are. "at a minimum. [to]
ensure that Glen Canyon Dam is operated in a manner
consistent with the requirements" of the amended
sections 1 and 3 of the CRSP Act (see (2) above).

Senate Bill--Section 5(b) states that "the Secretary
shall implement power operating criteria ... that will
ensure Glen Canyon Dam is operated in a manner
consistent with this Act." Given the structure of the
bill. the words "with this Act" would seem to mean
that these power operating criteria are to be
consistent with section 3 of the bill (see (2)
above) .

The concerns of the seven basin states. which are
applicable to any legislation. are set forth in the enclosed
"Position Paper on H.R. 4498." Items 1-3 on page 2 of the
position paper are the matters of interest to water users.
Items 4-5 are of concern to the power customers. While the
states have yet to take a position on the Senate bill. it is an
improvement over H.R. 4498 in that it seemingly deals only with
hydropower operations. not with annual storage and delivery
requirements. However. it still needs many drafting
improvements.

Attached to the position p.,er are handwritten.
interlineated amendments to B.R. 4498 which the states have
prepared. These will be the' subject of discussions with the
