<br />. <br /> <br />Agenda Item 7 <br />July 2. 1990 <br /> <br />impacts to. and improve the conditions <br />of the natural resources of Grand <br />Canyon National Park and Glen Canyon <br />National Recreation Area. under <br />operating criteria that are consistent <br />with the water storage and delivery <br />functions of Glen Canyon Dam pursuant <br />to the Colorado River Compact. the <br />Upper Colorado River Basin Compact.... <br />and other laws relating to regulations <br />of the Colorado River. <br /> <br />Note that this language refers to Glen Canyon Dam in <br />general. not just to the power plant. and to <br />"operating criteria." not to "power operating <br />criteria." However. section 5(b) of the bill. which <br />ties back to this section 3. refers to "power <br />operating criteria." See (5) below in this comparison <br />of the two bills. <br /> <br />Section 3 of the bill effectively amends. in my <br />opinion. section 7 of the CRSP Act (copy enclosed). <br />Section 7 directs that CRSP hydropower facilities be <br />operated "... so as to produce the greatest <br />practicable amount of power and energy that can be <br />sold at firm power and energy rates...." The Western <br />Area Power Administration has taken the position that <br />recreational and environmental considerations are <br />subservient to this language. Section 3 of the Senate <br />bill is intended to overturn Western's position. <br /> <br />(3) House Bill--Section 3 directs the Secretary of the <br />Interior to promulgate "emergency interim operating <br />criteria" for Glen Canyon Dam within 90 days after the <br />date of enactment of the bill. <br /> <br />Senate Bill--Section 4 requires the Secretary to <br />determine whether available scientific data are <br />sufficient to permit the implementation of "interim <br />power operating criteria" within 30 days after the <br />date of enactment of the bill. If the available <br />scientific data are reasonably sufficient. then the <br />Secretary has an additional 30 days in which to <br />implement interim power operating criteria. If the <br />data are not reasonably sufficient. then the Secretary <br />is directed to proceed as quickly as possible to <br />procure such data and to implement interim power <br />operating criteria not later than 30 days after <br />adequate data become available or. in any event. not <br /> <br />-4- <br />
