<br />.' <br /> <br />, <br /> <br />".: .., -.'1 <br />I, -.:.. _~ .: h,;~ <br /> <br />. <br /> <br />. <br /> <br />-12- <br /> <br />(b) The Secretary shall ahandon the acquired water rights. <br /> <br />(c) In exchange for the acquisition of said water rights, the <br />Secret~y shall make the following amounts of water availahle at the <br />Blue Mesa Reservoir, Colorado River Storage Project, without charge <br />and for so long as said reservoir remains in existence: <br /> <br />(1) The amount of 20,000 acre feet per year to the <br />Colorado Ute Electric Association, Inc. and its successors or <br />assigns for all heneficial Ilses, consumptive and non-consumptive; <br />and <br /> <br />(2) The amount of 5,000 acre feet per year to the City <br />of Delta and its successors and assigns for all beneficial uses, <br />consumptive and non-consumptive. <br /> <br />(d) The Secretary shall allocate such construction costs, and <br />annual operation, maintenance, and replacement costs of the Wayne N. <br />Aspinall Unit as is appropriate to reflect the supply of up to 20,000 <br />acre feet of water per year at Blue Mesa Reservoir to the Colorado Ute <br />Electric Association, Inc.. and up to 5,000 acre feet of water per <br />year at said reservoir to the City of Delta. All costs so allocated <br />shall be non-reimbursable, notwithstanding Section 6 of the Colorado <br />River Storage Project Act of lY56. <br /> <br />(e) In exchange for the loss of the proposed hydroelectric <br />facilities associated with its water rights to be acquired by the <br />Secretary, Colorado Ute Electric Association. Inc., shall he and <br />hereby is granted the right and option to finance, in return for the <br />benefits arising from associated capacity rights, the uprating of <br />existing hydroelectric facilities connected with the Wayne N. Aspinall <br />Unit of the Colorado River Storage Project. together with the right to <br />utilize water stored or diverted by said unit. to operate such uprated <br />capacity. <br /> <br />(1) Such rights and option of Colorado Ute Electric <br />Association, Inc. shall not preclude such other arrangements for <br />financing of, and distribution of the benefits of such uprating <br />as may be mutually agreed to by Colorado Ute Electric <br />Association, Inc.. the U. S. Bureau of Reclamation, and in <br />appropriate instances, the Western Area Power Administration. <br />
