COMPENSATION; RESERVATION. <br /> <br />(a) Any taking by the United States of a water right which is <br />vested under either State or Federal law at the time the designated <br />segment of the lower Gunnison River is included in the nation~l wild and <br />scenic rivers system shall entitle the owner thereof to just <br />compensation. <br /> <br />(b) Any reservation of water established as a result of this Act <br />by the inclusion of the designated segment of the lower Gunnison River <br />in the national wild and scenic rivers system shall be subject to the <br />provisions of this Act, shall be adjudicated in Colorado Water Court, <br />and shall have a priority date as of the date of enactment of this. <br />act. <br /> <br />SEC. 504. ACQUISITION OF COLORADO UTE AND CITY OF DELTA WATER <br />RIGHTS; SUPPLY OF WATER; UPRATING. <br /> <br />(a) In order to protect the recreational, scenic, fish, and <br />wildlife values of the designated segment and to avoid conflicts with <br />water rights vested under Colorado law, the Secretary is hereby <br />authorized and directed to acquire, within six months from the date of <br />enactment of this Act, the following water rights: <br /> <br />(1) Those water rights decreed to the Colorado Ute <br />Electric Association, Inc., in: <br /> <br />(A) Civil Action No. 3503 in former Water District <br />40 on March 20, 1954 for 72,650 acre feet for the Tri- <br />County Reservoir with an appropriation date of AprilS. 1948. <br /> <br />(8) Case No. 80 CW 322 in Water Division No.4 on <br />March 19, 1982, for the Tri-County Reservoir Hydroelectric <br />Station for 6,000 cfs non-consumptive and 60 cfs <br />consumptive, with two alternate points. <br /> <br />(C) Case No. 80 CW 323 in Water Division No.4, on <br />March 19, 1982, for alternate points of storage and <br />additional beneficial uses for the Tri-County Reservoir. <br /> <br />(2) Those water rights decreed to the City of Delta in <br />Case No. W3063 in Water Division No.4 on november 3, 1977, for <br />54,000 acre feet for the Smith Fork Hydroelectric Project. <br />
