"John Martin reservoir project" is the official name of the <br />facility formerly known as Caddo a reservoir project. authorized by <br />the f100d Control Act of 1936. as anended. for constructlon, <br />operation and maintenance by the war departr.1ent. corps of engineers. <br />later designated at the corps of engineers. department of the army, <br />and herein referred to as the "corps of engineers," "John Martin <br />reservoir" is the water storage space created by "John ~~art;n dam". <br /> <br />I <br /> <br />I <br /> <br />E. The "flood control storage" ;s th'lt portion of the total <br />storage space in John ~artin reservoir allocated to flood control <br />purposes. <br /> <br />I <br /> <br />F. The "conservation pool" is that portion of the total storage <br />space in John Martin reservoi~ lying below the flood control storage. <br /> <br />I <br /> <br />G. The "ditches of Colorado water district 67" 'are those <br />ditches and canals which divert water from the Arkansas river Qr its <br />tributaries downstreanl from John Martin dam for irri~ation use 1n <br />Colorado. <br /> <br />I <br /> <br />H. The term "river flow" means the sum of the flows of the <br />Arkansas and the Purgatoire rivers into John Martin reservoir as <br />dete~mined by gauging stations appropriately located above said <br />reservoir. <br /> <br />I <br /> <br />I. The term "the administration" means the Arkansas river <br />compact administration ~stabl ished under article VIII. <br /> <br />ARTICLE IV <br /> <br />I <br /> <br />Bath states recognize that: <br /> <br />I <br /> <br />A. This compact deals only with the waters of the Arkansas <br />river as defined in article III. <br /> <br />I <br /> <br />B. This tompact 1S not conterned with the rights. if any, <br />of the state of New Mexico or its- r.itizens in and to the use in <br />New Mexico of waters of Trinchera creek or other tributaries of the <br />Purgatoire river, a tributary of.the Arkansas river. <br /> <br />I <br /> <br />C. ll) John Martin dam will be operated by the corps of <br />engineers to store and release the waters Df the Arkansas rTVer in <br />and from John Martin reservoir fDr its authorized purposes. <br /> <br />I <br /> <br />{2J The bottDm of the flood control sto~age is presently <br />fixed by the chief of englneers, U. S. Army, at elevation 3,851 <br />feet above ~ean sea level. The flood control storage will be operated <br />for flood control purposes and to those ends will impound Dr regulate <br />the streamflow volumes that are in excess of the then available <br />storage capacity of the conservatlon pool. Releases from the flood <br />control storage may be ~ade at tlmes anj rates determined by the <br />corps of erlgineers to be necessary or advisable without regard to <br />ditch diversion capacities or require~ents in either or both states. <br /> <br />I <br /> <br />I <br /> <br />{3) lne conservation pool will be o~erated for the benefit <br />of water users in Colorado and Kansas, both upstream and downstrea~ <br />from John ~'~art;n dam, as provided in this compact. The maintenance <br />of John ~lartin dam and appurtenance works may at times rec;uire the <br />corps of engineers to release waters then impounded in the conserva- <br />tion pool or to prohibit the storage of water therein until such <br />maintenance work is completed. FlOOd control operation may also <br />involve te..porary utilization of conservation storage. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />O. This compact is not intended to impede or p~event future <br />beneficial develo~ment of the ~rkansas river basin in ColoradO and <br />Kansas by federal or state agencies, by private enter~rise, or by <br />combinations thereof, whiCh Ir,ay involve constructTon of dar.ls. <br />reservoirs and other works for the ourposes of water utiliZation and <br />control, as well as the improved or ;l1"'6longed func~;oning of eX1sting <br />works: Provided, that the waters of tne Arkansas river, as defined <br />in article Ill. shall not be materially depleted in usable Quantity <br />or avai labil ity for use to the water users in Colorado and Kansas <br />under this compact by ::'UC!l future develDpr,lent or construction. <br /> <br />I <br /> <br />-39- <br />
