Winter storage in John Martin reservoir shall commence on <br />November 1st of edch year and continue to anu include the next suc- <br />ceeding MdfCh 31st. Durlng said perlod all water entering said <br />reservoir up to the limit of the then available conservation capdeTty <br />shall be stored: Provided, that Colorado may demand releases of <br />water equivalent to the flver flow, but such releases shall not <br />exceed 100 c.f.s. (cubic feet per second) and water so released shall <br />be used without avoidable waste. <br /> <br />I <br /> <br />B. Summer storage in John Martin reservoir shall commence on <br />Apr17 1st of edch year and continue to and include the next succe- <br />eding October 31st. Ourin~ said period. except when Colorado water <br />users are operating under decreed priorities as provided in para- <br />graphs F and G of this article. all water enterinq said reservoir <br />up to the limit of the then available conservation capdcity shall be <br />stored: Provided. that Colorado Inay demand releases of water <br />equivalent to the rlver flow up to 500 c.f.s.. and Kansas may demand <br />releases of water equivalent to that portlon of the rTver flow <br />between 500 c.f.s. and 750 c.f.s., irrespectlve of releases demanded <br />by Colorado. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />C. Releases of water stareu pursuant to the provisions of <br />paragraphs A and B of this article shall be made upon demands by <br />Colorado and Kansas concurrently or separatelY at any time dur1ng <br />the su~mer storage periOd. Unless increases to meet extraordinary <br />conditions are authorized by the administration, separate releases <br />of stored water to Colorado shall not exceed 750 c.f.s., separate <br />releases of stored water to Kansas shall not exceed 500 c. f.s., and <br />concurrent releases of stored water shall not exceed a total of <br />1250 c.f.s.: Provided, that when water stored in the conservation <br />pool is reduced to d Quantity less than 20.000 dcr.e-feet, separate <br />releases of stored water to Colorado shall not excee~ 600 c.f.s., <br />and separate releases of stored water to Kansas shall not exceed <br />400 c.f.s., and concurrent releases of stored water shall not exceed <br />1,000 c.f.s. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />D. Releases authorized by paragraphs A. (1) Releases of stored water and releases of river flow may <br />be made simultaneously upon the de:,laI1ds of either or both states. <br /> <br />I <br /> <br />(2) Water released upon COncurrent or separate demands shall <br />be appl led promptly to beneficlal use unless storage thereof dewn- <br />stream is authorized by tile aOr.lin1st"ratiun. <br /> <br />I <br /> <br />(3) Releases of river flow and of stored water to Colorado <br />shall be neasured by gauging stat10ns located at or near John ~art1n <br />dam and the releases to wnich Kdnsas is entitled shall be satisf~ed <br />by an equivalent in state line flow. <br /> <br />I <br /> <br />(4) ~hen water 15 released fr0m John Martin reservoir appro- <br />priate allowances as determined by the ad;:-,lnistration shall be i.1ade <br />for the intervals of tlne required for such water to arrive at tre <br />points of diversion in Colorado and at the state line. <br /> <br />I <br /> <br />(5) There shall be no allowance or accu~ulation of credits <br />or debits for or agalnst either state. <br /> <br />I <br /> <br />(6) Storage, releases fro~ storage and releases of river <br />flow authorized in thlS article shall be acco~pl1she~ pursuant.to <br />procedures preSCrlbec by the adl~inistration under the prO'llsions <br />of article VIII. <br /> <br />I <br /> <br />-40- <br />
