<br />001089 <br /> <br />.' <br /> <br />y <br /> <br />,~REASr the reoent decision of the Supreme Court of the <br />United States in the case entitled, "The United States of Amerioa, <br />Petitioner, vs. Appalachian Eleotric Power CompBllY", (known as the <br />"New River" oase) has enlarged and extended the definition and con- <br />ception of a "navigable stream" beyond the interpretation thereof <br />heretofore entertained by the inhabitants of the arid and semi-arid <br />regions of the west; <br /> <br />. <br />.,',i <br /> <br />1.;, <br /> <br />. <br /> <br />THEREFORE BE IT RESOLVED, by the oonference of Go~ernors, <br />and their representatives of the Western States in session at Denver, <br />Colorado, on th9 7th day of February A. D. 1941, that a oommittee of <br />five be appointed by the presiding officer of this conference for <br />the follOWing purposes: <br /> <br />. . <br /> <br />" <br /> <br />1. To review and study the "llew River" decision to determine <br />its affects on the rights of the states and their oitizens in the <br />appropriation and utilization of waters of western ri~ers under state <br />laws. <br /> <br />. <br /> <br />, <br /> <br />2. To review and study, 1n view of this decision, pertinent <br />federal ~gislation and prepare suggested amendments to such legis- <br />lation which appear appropriate and advisable far the proteotion of <br />the rights of states and their citizens in the waters of western rivers <br />.f the United States far irrigation and ather beneficial purposes. <br /> <br />3.
