<br />. <br /> <br />. <br /> <br />6 <br /> <br />plan has been developed based on using water purchased through Dolores Project <br /> <br />land acquisition and stored and released from the recently completed McPhee <br /> <br />Reservoir. The beneficial use support is being developed based on benefits to <br /> <br />Colorado consisting of improved water quality for downstream water users within <br /> <br />the state. This improved water quality will provide usable water to existing <br /> <br /> <br />water right holders for a longer period of time through the irrigation season <br /> <br /> <br />in addition to improved aquatic and wildlife habitat. These are benefits tied <br /> <br /> <br />solely to Colorado and do not account for the water quality improvement of the <br /> <br />Colorado River in the Lower Basin, the projects primary objective. <br /> <br />A draft decree has been developed through the U.S. Justice Department <br /> <br />describing the beneficial use plan and beneficial use approach. This decree <br /> <br />also includes a request to change the point of diversion in the existing <br /> <br />conditional water rights to include the new 5 production wells. The totalS <br /> <br />cfs right would not be changed. The maximum of all wells pumped would not <br />exceed this rate. <br /> <br />This draft decree was filed in District Court 4 and opposition was filed by the <br /> <br />State Engineer's Office and the Colorado Water Conservation Board. The <br /> <br />opposition was unclear and negotiations are underway between Reclamation, the <br /> <br />Justice Department, and the State of Colorado to resolve these issues. We <br /> <br />anticipate re-wording this decree to the satisfaction of all parties and <br /> <br />refiling it.
