.

.

5

the fall of 1982. The east well field was pumped throughout the last half of

1983. Brine inflow results are presently being analyzed. A contract was

completed in February 1984 to re-develop the 5 newer wells to improve brine

production. Results of this work are also presently being evaluated.

In summary hydrologic analysis still indicates 90 percent of the brine inflow

(180,000 tons of salt annually) can be controlled by pumping 2 cfs (900 gpm).
Continuously changing hydrologic conditions will require continuous
modifications and additions to the well field and its operation.

Water Rights

Permits and water rights have been kept as current as possible within state

law. Well permits for the original 19 production wells were obtained and are

currently in the process of being extended. Current permits have also been

obtained on the 5 new wells. Conditional water rights for 5 cfs of water were

granted by the state for testing of the well field. This was based on the

original 19 wells. Due diligence justification will be presented to the State

District Court 4, this spring to extend these conditional rights.

Water storage rights were obtained for the proposed Radium Evaporation Pond

site. A due-diligence statement was filed and these rights were recently

renewed.

OOC541

Permanent water rights in the State of Colorado must be based on having shown

actual beneficial use. Therefore until the Paradox Unit is completed,

permanent water rights cannot be granted. Along with beneficial use, an

augmentation plan must be provided and accepted by the state. An augmentation

_~_~~-E,-,~,-,~.o:':?!S.Y;1;}-:1_\~r:;;r;::::~!:'?,::,::t-:~'F~~P!i.<;;;:'~t,._ .....~, "0~,-~";. :.'f!..t.;':'i(,~,~.J~:;{tt':f ..,,:;;"..:<:'k::'T~?:1~~.::::7,~.7'.I~;;':.l:__~?'"..._ ;~, :;::L;-'~':;;:,:';" 7<~_, '~,-,~:';..:2u:....'\~:;;;:~~"2T~~:5' :\;,:,.~::.;,;,:~\~'J;'~,-,:#,::.'.';.7_:':"'S:-:"_::;'''':. -;7',-":'";
