Dollar credits for unused purchased water at the end of the year will be refunded at that time or on receipt of a signed release of allocated water, whichever occurs first. ". 12. On or before August 1 of each year, each customer will reaffirm his intent to use water allocated to him before November 1, or to release tile remainder for re-allocation by the Board of Directors. 13. Requests for Project water must be received on or before March 1 of each year. and the Board of Directors will advise of allocation not later than April 1 of each year. 14. Water delivered to municipalities and lor industry will be supplementa~ only. unless otherwise agreed upon by the Board of Directors. Chairman Nichols stated the Executive Committee would meet again in the near future to develop additional language and recommenda.tions. Project Manager Ogilvie comp- linlented the Executive Comrnittee on the 14 points, and sees no conflict with either the Operating Principles or the Contract. Bei.e suggested that the Director. and all others should remember this is preliminary language for the allocation program and should not be construed as being final in any sense of the word. LEGAL COMMITTEE: Attorney Beise reported he had attended several m.eetings of the Senate Water Committee as a representative of the Water Section of the State Bar Association, and that amend- . ments had been suggested for Senate Bill. 37 and 40. Bei.e also advi.ed that on Monday March 4, the District would join with the Bureau of Reclamation before t.l).e District Court in Glenwood Springs to submit proof of Due Diligence. Attorney Bei.e stated that on April 18, the District would appear before the Court in District 12 to also show proof of Due Diligence. Beise then read a letter from John Werme and Don Peaker requesting to see copies of the Woodward-Clyde-Sherard report on the CF&! proposal, but that since the report was paid jointly by the CF&I and the District, he wrote to them advising that it would not be available for inspection. Beise reported that the briefs for the Conservancy District in the Records Case, before the Supreme Court, were filed this day, and the plaintiffs will have 20 days to respond. LEGISLA TIVE COMMITTEE: Chairman Dilley stated he had attended a meeting of the Senate Water Conunittee on Jan- uary 31, and General Manager Thomson had attended other water'meetings. Thomson reported that the present .tatus of most Water Legi.lation is that all Bills are in Com- mittee with the exception of Senate Bill 37, which wa. referred out amended. and that Attorneys for water users feel that Senate Bill 37 in its amended form would be good Leg- islation to be passed by this Session of the Legislature. He stated he would keep the Directors fully informed as to the progress of Water Legislation. . RIVER ADMINISTRATION & EDUCATION: President Nichols advised that Chairman Wagner was unable to attend this meeting, be- cause of illness, and asked Manager Thomson to report.
