<br />The revised regulation was published in compliance with an order of
<br />
<br />the U.S. District Court for the District of Columbia and became effective
<br />
<br />upon its publication in the Federal Register. As announced at that time,
<br />
<br />the Corps of Engineers plans "a moderate and reasonable approach in
<br />
<br />expanding its authority in a three-phase program over the next two years."
<br />
<br />Phase I, permit procedures now applicable to traditional "navigable
<br />
<br />waters of the United States" are extended to include adjacent wetlands.
<br />
<br />Phase II, effective July 1, 1976, will expand the regulation to cover
<br />
<br />primary tributaries of "navigable waters of the United States," natural
<br />
<br />lakes with more than five surface acres and their adjacent wetlands.
<br />
<br />Phase III, beginning July 1, 1977, will extend Corps authority into
<br />
<br />other "navigable waters," generally up to the headwaters.
<br />
<br />Following the four regional meetings conducted by the Office of the
<br />
<br />Chief of Engineers, Corps' district engineers will conduct local public in-
<br />
<br />formation meetings. These will explain provisi0ns of the revised regulation
<br />
<br />and will be forl~s for discussion of local applications. Dates and locations
<br />
<br />of these meetings will be announced later.
<br />
<br />Corps officials also will meet with state and local officials and
<br />
<br />coordinate activities with regional offices of the Environmental Protection
<br />
