.,.,'
~

~

Section 5(c) requires the
implementation of long-term operating
procedures for Glen Canyon Dam. The
interim and the long-term operating
procedures implemented pursuant to sections
4(a) and 5(c) could interfere with the
monthly and annual reservoir operations for
international treaty and interstate compact
purposes pursuant to section 602 of the
1968 Act and to the Coordinated. Long-Range
Operating Criteria if restrictions on the
minimum or maximum flows from Glen Canyon
Dam (a power operations issues) and/or
requirements to vacate space in Lake Powell
(a flood release issue) caused different
volumes of water to be released on a
monthly and annual basis then would
otherwise be the case. The language of
sections 3(a). 3(b)(1). 4(a)(1). and 5
(c)--which directs that the operating
procedures be "subject to and consistent
with." or "not interfere with." the primary
water storage and delivery functions of
Glen Canyon Dam pursuant to the Colorado
River Compact. the Upper Colorado River
Basin Compact. and the other laws relating
to regulation of the Colorado River (e.g..
section 1 of the 1956 Act and Title VI of
the 1968 Act are not affected by H.R.
4498)--requires that this not happen. In
other words. minimum flows cannot be set so
high. maximum flows cannot be set so low.
and/or reservoir space cannot be vacated in
such amounts or at such times that the
monthly and annual volumes of water to be
released for international treaty and
interstate compact purposes are in any way
altered. impaired. or adversely affected.

The Committee urges the Secretary to
consult with the Governors of the seven
Colorado River Basin States. scientific
experts. and the pUblic to formalize
long-term procedures for flood control
releases and to include these procedures in
the long-term operating procedures prepared
pursuant to section 5(c). At a minimum.
the current. informal standard of limiting
flood releases to once in 20 years [on the
average] should be formalized through the
open. pUblic process contemplated in this
section.

-4-
