<br />.,.,' <br />~ <br /> <br />~ <br /> <br />Section 5(c) requires the <br />implementation of long-term operating <br />procedures for Glen Canyon Dam. The <br />interim and the long-term operating <br />procedures implemented pursuant to sections <br />4(a) and 5(c) could interfere with the <br />monthly and annual reservoir operations for <br />international treaty and interstate compact <br />purposes pursuant to section 602 of the <br />1968 Act and to the Coordinated. Long-Range <br />Operating Criteria if restrictions on the <br />minimum or maximum flows from Glen Canyon <br />Dam (a power operations issues) and/or <br />requirements to vacate space in Lake Powell <br />(a flood release issue) caused different <br />volumes of water to be released on a <br />monthly and annual basis then would <br />otherwise be the case. The language of <br />sections 3(a). 3(b)(1). 4(a)(1). and 5 <br />(c)--which directs that the operating <br />procedures be "subject to and consistent <br />with." or "not interfere with." the primary <br />water storage and delivery functions of <br />Glen Canyon Dam pursuant to the Colorado <br />River Compact. the Upper Colorado River <br />Basin Compact. and the other laws relating <br />to regulation of the Colorado River (e.g.. <br />section 1 of the 1956 Act and Title VI of <br />the 1968 Act are not affected by H.R. <br />4498)--requires that this not happen. In <br />other words. minimum flows cannot be set so <br />high. maximum flows cannot be set so low. <br />and/or reservoir space cannot be vacated in <br />such amounts or at such times that the <br />monthly and annual volumes of water to be <br />released for international treaty and <br />interstate compact purposes are in any way <br />altered. impaired. or adversely affected. <br /> <br />The Committee urges the Secretary to <br />consult with the Governors of the seven <br />Colorado River Basin States. scientific <br />experts. and the pUblic to formalize <br />long-term procedures for flood control <br />releases and to include these procedures in <br />the long-term operating procedures prepared <br />pursuant to section 5(c). At a minimum. <br />the current. informal standard of limiting <br />flood releases to once in 20 years [on the <br />average] should be formalized through the <br />open. pUblic process contemplated in this <br />section. <br /> <br />-4- <br />
