<br />(5) Needs of potential exporting states for early project <br />development on the stream(s) invol ved for instate purposes <br /> <br />12 <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />'from adjacent areas' into the High Plains - Ogallala Aquifer <br />Region: and <br /> <br />"Whereas P.L. 94-587 requi res that if such water transfer(s) are <br />found to be a part of "a reasonable solution," the "Secretary (of <br />Commerce) . . . shall incl ude a recommended pl an for all ocati ng and <br />distributing water in an equitable fashion, taking into account <br />existing water rights and the needs for future growth of all <br />a ffected areas;" and <br /> <br />"Whereas the Corps of Engineers, under separate agreement with EDA, <br />and the General Contractor under Study Element B-1, are now <br />cooperatively pursuing the technical aspects of alternative water <br />interbasin transfer possibilities, both intrastate and interstate; <br /> <br />"Now therefore be it resolved that (1) the interbasin transfer study <br />element is of significant importance to the High Plains - Ogallala <br />Aquifer Study both within and without the High Plains - Ogallala <br />Aquifer Region; (2) P.L. 94-587 requires such interbasin transfer <br />study; (3) there is need to provide a friendly and equitable <br />understanding of these studies among the six states involved, those <br />states from which potential transfers might be considered and those <br />through whi ch poss i b 1 e conveyance aqueducts woul d pass; and that <br />(4) the High Plains StUdy Council is stating the following diver- <br />sion concepts and assurances: <br /> <br />(1) The present uses and prospective future needs for benefi- <br />cial purposes for the foreseeable future in the potential <br />basin(s) of origin of surplus water will be considered as <br />having prior rights to the waters involved. Likewise, present <br />uses from and prospective future demands on the stream(s) out- <br />s i de the bas in (s) of ori gi n in accordance with state water <br />plans, will be considered as having prior rights. Only those <br />amounts of water estimated to be surplus to those present uses <br />and future needs will be recognized as being potentially <br />available for exportation to the High Plains - Ogallala <br />Aquifer Regi on. <br /> <br />(2) Existing compacts, water rights, contracts and commit- <br />ments will be considered to remain in effect in estimating <br />exportable surpluses. <br /> <br />(3) Future upstream depl eti ons and future downstream flow <br />requirements for instream uses will be estimated in calcu- <br />lating potential surpluses. Instream uses to be considered <br />include but are not limited to fish and wildlife, navigation, <br />quality control, hydropower generation, recreation and <br />esthetics. <br /> <br />(4) State water pl ans for downstream states for development <br />and utilization of the waters of the stream(s) involved <br />will be taken into account. <br />
