<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />,f'.,f'~: !:' ~ e. <br />u''J..-,:J':-: ; <br /> <br />CHAPTER TWO <br />HIGH PLAINS STUDY COUNCIL POLICIES <br /> <br />As a part of the legislation authorizing the Six-State High Plains- <br />Ogallala Aquifer Region Study (P.L. 94-587), the Corps of Engineers was <br />directed to conduct a stUdy of alternatives for transferring water "from <br />adjacent areas" into the High Plains-Ogallala Aquifer Region. P.L. 94-587 <br />requires that if such water transfer(s) are found to be "a reasonable solu- <br />tion", the "Secretary (of Commerce) . . . shall include a recommended plan for <br />allocating and. distributing water in an equitable fashion, taking into account <br />existing water rights and the needs for future growth of all affected areas." <br /> <br />The Corps of Engi neers, under separate agreement with EDA, and the <br />General Contractor under Study Element B-1, cooperatively pursued the tech- <br />nical aspects of alternative water interbasin transfer possibilities, both <br />intrastate and interstate. Because of the importance of this part of the <br />High Plains-Ogallala Aquifer Study both within and without the High Plains- <br />Ogallala Aquifer Region, and most significantly, the need to provide a <br />friendly and equitable understanding of these studies between the six states <br />involved, and those states from which potential transfers might be considered <br />or through which possible conveyance aqueduct(s) would pass, the High Plains <br />Study Council initiated an analysis of interbasin diversion concepts and <br />assurances. These concepts and assurances provide the framework for the <br />protections required by P.L. 94-587, and the basis for discussions of diver- <br />sion alternatives with the states from which water export may be considered <br />and the intermediate states that might be involved. <br /> <br />High Plains Study Council Resolution No.6, adopted January 16, 1980, <br />provided those concepts and assurances.
