<br />" <br /> <br />2. Whenever possible, attempt to buy an entire water right in order <br />to avoid minority shareholder problems. <br /> <br />3. Attempt to purchase those systems or portions of systems that <br />operate least efficiently in terms of volumes of water use and <br />agricultural productivity. <br /> <br />. In the event Colorado must repay Kansas for obligations incurred prior to the <br />decision of the Supreme Court of the United States rendered May 15, 1995, <br />and repayment is required in water, the State of Colorado should purchase <br />rights to a permanent, renewable supply of water. After the debt is repaid, <br />such water should be available for lease or purchase in the following order of <br />preference: I) by well owners within the Arkansas River basin -for <br />augmentation purposes, and, 2) for other beneficial purposes. In order to <br />manage any such rights in accordance with the previously principles and to <br />manage any such other water supplies and related facilities that it may acquire <br />for the benefit of the citizens of the Arkansas River basin, the General <br />Assembly should consider action to create a regional entity consisting of <br />members representing both surface and ground water interests in proportion <br />to the use of water within the Arkansas River basin of Colorado to act in trost <br />on behalf of the People of Colorado. Furthermore, the state should not lease <br />water which may become available on the spot market for the purpose of the <br />repayment of prior obligations which would place it in competition with efforts <br />of well owners to replace their subsequent depletions. <br /> <br />. The State Engineer should appoint an Advisory Committee conslSttng of <br />members of the Trost Committee and other members representing both surface <br />and ground water users in the basin for the purpose of providing advice <br />concerning approval of replacement plans and other matters related to any <br />roles governing measurement, diversion, and use of tributary ground water in <br />the Arkansas River basin. <br /> <br />. Authorization should be provided the State Engineer, as Director of the <br />Colorado Division of Water Resources, and the Attorney General to hire <br />adequate additional FTE and that sufficient funds be allocated to cover the <br />costs of employing and equipping such persorulel and to provide for the <br />operating costs associated with full implementation and enforcement of a <br />ground water regulation program within the Arkansas River basin. <br /> <br />. The Department of Natural Resources, which includes the State Engineer's <br />Office, the Colorado Water Conservation Board, the Division of Wildlife, and <br />the Division of Parks, should review the Water Acquisition Subcommittee's <br /> <br />22 <br />
