On page 7 of the Conceptual Alternative is the statement that: <br />According to the Bureau of Reclamation, an IlWestment of <br />approximately $1"0 million, some or which may be available <br />through sources Independent of the Fund for the speclftc purpose <br />of enhanclnc the safety of the dam [at Lemon Re5e"'olrJ, would <br />implement this option [making approximately 2,500 acre-feet of <br />additional water aYallable In Lemon Reservoir]. <br />a. Who owns and controls Lemon Reservoir? <br />b. Who owns the water storage rights for Lemon Reservoir? <br />c, Could 10,000 acre-feet of additional water be stored in Lemon Reservoir <br />under existing water storage decrees if the existing dam were raised? <br />d. Could the additional water be furnished to the Tribes for any purpose, <br />including municipal and industrial use, under existing storage decrees? <br />e. Under existing contracts for delivery of water from LemOn Reservoir, <br />could the United States increase Lemon dam and enlarge Lemon Reservoir to provide <br />additional water to the Southeru Ute Tnbe? <br />f. Increasing the size of Lemon Dam may not be possible, as we <br />understand land slides are a problem. Also. we need an estimate of the cost, environmental <br />impact and the potential impact on endangered species. <br />17. On page 8 of the Conceptual Alternative, under the heading h Additional <br />conditions on the Fund" are various statements, including <br />Acquisitions of private fee land by the Tribes would be tu <br />neutraI, . . . . ThIs could be accomplished through SCW'eraJ <br />diff'erent mechanisms." <br />a. Would acquisitions of private fee land by the Tribes become part of the <br />reservations? <br />b. Would the acquisitions of private fee land continue to be subject to <br />taxation by local governments? If so, who would pay the taxes? <br />c. If water rights used on irrigated cropland are converted to municipal <br />and industrial use by the Tnbes (or not irrigated in order to generate revenue from the use <br />of the water rights) and the land is dried up, would payments equivalent to taxes on irrigated <br />cropland continue to be paid to local governments? <br />d. What are the different mecbAfti..1l\S so that adverse tax revenue <br />consequences for local government are avoided? <br />e. Who would pay so that adverse tax consequences for locallOVermnent <br />are avoided? <br />f. What would be the cost to avoid the adverse tax consequences for local <br />governments? <br />The acquisition will Dot Impact existing users. <br />g. Who would pay the legal and engineering costs to change water rights <br />decreed for irrigation use to other uses to ensure that the acquisition and use of the water <br />rights for other purposes wiII not impact existing users? How much do you estimate such <br />costs to be? <br />h. Who would pay the costs to revegetate agricultural land if the Idd is <br />dried up in order to generate revenue from the use of the water rights for other purposes? <br />How much do you estimate such costs to be?
