<br />~r: :' <br /> <br />o <br />('") <br />N <br />~ <br />l"\:) <br />en <br /> <br />(5) Prevent encroachment on the diversion and outlet channels, <br />which would reduce their design capacities, and give satisfactory assur- <br />ances that they will maintain: (a) the Oak Creek outlet channel design <br />gapacity of 3,280 c.f.s.; (b) the Coal Creek outlet channel design <br />capacity of 440 c.f.s. to the existing Coal Creek floodway; and (c) <br />the capacity of the existing Coal Creek floodway to at least 1,490 <br />c.f.s. through the city of Florence; <br /> <br /> <br />(6) Periodically inform all concerned, in a manner satisfactory <br />to the Secretary of the Army, that some flooding will continue to occur <br />because of temporary ponding; <br /> <br /> <br />(7) Prohibit encroachment on the capacities of the interior <br />drains and ponding areas and the flood-carrying capacities of the <br />improved river channels, and if ponding areas and capacities are <br />impaired, provide promptly, without cost to the United States, sub- <br />stitute storage or equivalent pumping capacity; <br /> <br />(8) Take steps to prevent encroachment,upon existing defined <br />waterways tributary to the projects, by zoning or other means, such as <br />enlargement or other modification of the existing waterway facilities, <br />to prevent minor flood problems on these tributary waterways from <br />developing into problems of serious proportions; <br /> <br />(9) Provide guidance and, leadership in preventing unwise and <br />uneconomical future development, of the flood plain areas by encour- <br />aging prudent use of flood proofing, ,land regulation planning, or other <br />flood plain management techniques to reduce flood losses; <br /> <br />(10) Allow public access to recreation, and fish and wildlife <br />areas provided by the projects; <br /> <br />(11) Provide the water ,necessary to develop and maintain the <br />wetland areas proposed for mitigation of project-induced damages to <br />wildlife estimated to be 750 acre-feet initially and 75 acre-feet <br />annually thereafter; and <br /> <br />(12) Contribute in cash 9 .4 percent of the total Federal con- <br />struction cost. of the floodway and. major drainage project from Brewster <br />to Florence and 2.0 percent. of the channelization and major drainage <br />project from Pueblo to .a.pointnear, Las, Animas, presently estimated <br />at $64,000 and $846,000, respectively. <br /> <br />In the public Notice, of. Report , dated October 17, 1968, the <br />Divisl.on Engineer concurred in: the. plan of improvement recommended by <br />the D1strict Engineer, subject,.to, the proviso that additional studies <br />of the Pueblo, Local Protection Project be made concerning the feasi- <br />bility of providing a higher degree. of protection to urban areas by <br />reservoirs in the Fountain Creek watershed or by other works.
