The duties and responsibilities of the Commission are included in <br /> <br />a guidelines document which was adopted by the Commission on August 3. 1976. A <br /> <br />readlnn of this document indicates that responsibility for many activities Is <br /> <br />shared 'between the Commission and the Division. This sharing of responsibility <br /> <br />had led to some confusion about lines of responsibility and produced inefficiencies <br /> <br />In accomplishing the work charged to these two organizational units. The Office <br /> <br />of Health Protection in the Health Department is currently working on plans to <br /> <br />improve the relationship between the two entities. Efforts are underway to es- <br /> <br />tabllsh common understanding and acceptance of mutual goals and objectives and to <br /> <br />prioritize the work activities of the Commission. <br /> <br />Penalty negotiation in enforcement actions and water qual ity standards re- <br /> <br />view are two specific activities which require better role clarification between <br /> <br />the Comm1sslon and the Division. <br /> <br />Site approval for sewerage systems is one of the most time consuming ac- <br /> <br />tivities which has hampered the effectiveness of the Division and Commission. <br /> <br />The State Water Quality Act requires Commission approval of these numerous <br /> <br />requests. In addition to an Inordinate amount of time being spent by the Com- <br /> <br />mission on these requests. the district engineers spend approximately 15% of <br /> <br />their time doing site reviews in connection with these approvals. As a solution <br /> <br />to this problem. the Commission could delegate responsibility for site approvals <br /> <br />to the Division and yet retain authority to hear appeals If the applicant dls- <br /> <br />agrees with the Division's decision. Such a delegation may require a change <br /> <br />in the State legislation. However. administrative remedies are now being In- <br /> <br />vestigated to alleviate the disproportionate work load without actually requlr- <br /> <br />ing statutory changes. <br /> <br />The relationship between the Commission and the Division needs to be <br /> <br />III - 2 <br />
