<br />(') <br /> <br />..,......,: <br />'.;a. <br />(', <br />Q <br /> <br />River. exclusive cf supplies imported from other stream systems. of all ir- <br /> <br />rigating ditches in Water Districts 14, 17, 67 in Colorado. as herein pre- <br /> <br />viously more fully defined; provided. <br /> <br />(1) that the said interstate relations, though defined for con- <br /> <br />venience as a fixed percent, may vary from day to day, month to month, <br /> <br />season to season, and year to year, and by eye les of years, in the future, <br /> <br />in the same manner and to the same extent as the said re lations have varied <br /> <br />in the past, prior to the construction of the Caddoa projeot; and provided. <br /> <br />(2) that at times when the irrigation pool in Caddoa Reservoir <br /> <br />is empty. the rights of appropriators in Colorado, as decreed by the Courts <br /> <br />of the State, shall be administered as in the past in accordance with their <br /> <br />respective priori ties. and as though the Caddoa project had not been con- <br /> <br />structed; and at such times nO appropriator, water user, ditoh. reservoir <br /> <br />or other olaimant in Colorado, either above or below Caddoa, or any group <br /> <br />thereof, may be denied or limited in his or its right of diversion or use <br /> <br />of water in order to provide supplies for storage in Caddoa Reservoir, or <br /> <br />to supplsment or increase the Stateline flows entering Kansas. regardless <br /> <br />of the status at the time of the relation between the two States, whether <br /> <br />more or less than the said 12.4 percent; and provided. <br /> <br />(3) that at times when waters impounded in Caddon Reservoir are <br /> <br />being released for diversion and use by ditches domstreron in Hater Dis- <br /> <br />triot 67 in COlorado, such additional amounts shall be released. for de- <br /> <br />livery and measurement at the State line, as may be required to supplement <br /> <br />the state line flows errl;ering Kansas (trom tributary inflows, return flows <br /> <br />and other accretions below Caddoa).. and thereby maintain the said average <br /> <br />interstate relation; provided however. <br /> <br />(8 ) <br />
