<br />interpreted as defining the requirements of the Colorado River Compact. No <br /> <br />other substantive changes were adopted by the Secretary of the Interior based <br /> <br />on recommendations of the Upper Division States. <br /> <br />In reflecting on the operating criteria, Mr. Goslin stated that the <br /> <br />Department of the Interior refused to acknowledge in the criteria that the <br /> <br />primary reason for including section 602 in P.L. 90-537 was to assure <br /> <br />that Upper Basin consumptive uses would not suffer because of a failure to <br /> <br />store sufficient water to make deliveries to satisfy the Mexican Water Treaty <br /> <br />obligation and to deliver 75 million acre-feet of water at Lee Ferry every <br /> <br />period of ten consecutive years for the benefit of the Lower Basin. Mr. <br /> <br />Goslin opined that had it not been for the insistence of the Upper Division <br /> <br />States, section 602 would probably not have appeared in P.L. 90-537. Mr. <br /> <br />Goslin made the following observation: <br /> <br />In the criteria this primary purpose of Section 602 has been <br />downgraded to the point where a situation has been created under <br />which the Upper Division has been assured of future risk instead <br />of protection. <br /> <br />The Upper Colorado River Commission passed a resolution on February 27, <br /> <br />1971 that addressed the Long-Range Operating Criteria. The resolution <br /> <br />stated, in part: <br /> <br />that the four upper division States hereby strenuously <br />protest the objective of the Secretary of the Interior of a minimum <br />release of 8.23 million acre-feet of water per year from Lake <br />Powell which violates the spirit of the Colorado River Compact and <br />places upon the upper division States an obligation not intended <br />under said compact; <br /> <br />the Upper Division States hereby affirm that they do not <br />waive their objections to other parts of the long-range reservoir <br />operation criteria . <br /> <br />On February 5, ,1975, the Bureau of Reclamation issued a draft document <br /> <br />titled "Coordinated Operation of Lake Powell and Lake Mead, Operational <br /> <br />Guidelines." The document was to be a guideline for the day-to-day operation <br /> <br />10 <br />
