<br />On December 16, 1969, the Secretary of the Interior mailed copies of the <br /> <br />proposed long-range operating criteria to the Governors of the seven Basin <br /> <br />States. The proposal omitted any reference to the 98.4+% or any other rule <br /> <br />curve. <br /> <br />On March 31, 1970, the Governors of the Upper Division States transmit- <br /> <br />ted their comments on the Long-Range Operating Criteria to the Secretary of <br /> <br />the Interior. The Governors petitioned the Secretary to include the 98.4+% <br /> <br />rule curve stating that "A rule curve with a lesser probability designation <br /> <br />under those studies will not be acceptable" (emphasis in original). It is <br /> <br />worth noting that the 98.4+% rule curve was under attack by the Lower Divi- <br /> <br />sion States. The exclusion of any rule curve from the Long-Range Operating <br /> <br />Criteria appears to have been an attempt by the Secretary to satisfy both the <br /> <br />Upper and Lower Division States. <br /> <br />On June 8, 1970, the Secretary of the Interior transmitted copies of the <br /> <br />I1Criteria for Coordinated Long-Range Operation of Colorado River Reservoirs" <br /> <br />as published in the Federal Register to interested parties. <br /> <br />IvaI V. Gos lin, <br /> <br />Executive Director of the Commission, issued a memorandum dated July 8, 1970 <br /> <br />to the Upper Colorado River Commission comparing the published criteria and <br /> <br />the draft of December 16, 1969. Mr. Goslin explained that the Upper Division <br /> <br />States were successful in securing deletion of the word "contracts" from the <br /> <br />following statement of the preamble: <br /> <br />Criteria to be administered consonant with Federal laws, <br />contracts, Treaty, compacts and decrees. <br /> <br />The effect of this deletion was to keep power and water contracts from being <br /> <br />elevated to a level of importance with compacts and the Mexican Water Treaty. <br /> <br />Mr. Goslin stated that the Upper Division States were also successful in <br /> <br />securing a disclaimer clarifying that target releases were not to be <br /> <br />9 <br />
