Accordingly, the <br />contractual obligation to the City of Farmington made in Reclamation's contract with the City is <br />illegal at such times as it results in loss of water needed to provide water pursuant to contracts for <br />the Navajo Reservoir Supply or in the inability of the State of New Mexico to consumptively use <br />water under its compact apportionment. For example, when full demand is placed on Navajo <br />Reservoir for water supply and endangered fish flows under the two action alternatives, there will <br />be no excess water available to continue releases for 7-10 days after determining that releases need <br />to be curtailed solely for generation of hydroelectric power. Reclamation needs to revisit and <br />renegotiate with the City of Farmington its contractual obligation. <br /> <br />Also, the text ofthe bullet statement does not relate to water supply contracts.
