<br />34 REPORT OF COLORADO RIVER COMMISSION OF NEVADA <br /> <br />State or Nevada, and the commission is authorized and directed to <br />negotiate for and obtain and enter: -into and execute and cause to be <br />executed such contracts, documents and instruments as are appro- <br />priate and requisite to carry such requests into effect. <br />2" In the contracts, documents and instruments referred to in <br />subsection 1, the commission is authorized: <br />(a) To obligate itself and tbe State of Nevada to repay the cost of <br />water service facilities constructed by the United States; <br />(b) '1"0 obligate itself to operate and maintllin water service facili- <br />ties constructed by the United States; <br />(c) To sen Colorado River water, at wholesale, and deliver it <br />through water service facilities constructed by the United States <br />under contracts to be approved by the United States and upon <br />charges which will yield to the commission revenues sufficient to <br />repay the costs of such facilities and their operation and mainte. <br />nance and, in addition, the cost or the water; <br />(d) To require each purchaser of Colorado River water from the <br />commission to exercise such powers as such purchaser may possess <br />to levy and collect taxes or assessments for the purposes of meeting <br />the charges payable to the commission; and <br />(e) To agree to institute in the eighth judicial district court of the <br />State of Nevada, and to prosecute to final judgment, including appel- <br />late review, proceedings to determine- the validity 0'r any contract or <br />other obligation cntered into with thc United States under the provi. <br />sions of sub.section 1. Jurisdiction. is herHby conferred upon such <br />court, and generally upon each of the district courts of the State <br />of Nevada, to conduct proceedings. for such purpose as in the ordi~ <br />nary case of the judicial determination of proceedings, contracts, <br />bonds and (J bligations of water conservancy districts. a,s provided in <br />NRS 541.380' to 541.420, inclusive. Such proceedings may be initiated <br />by and in the name of the' commission. rrhe commission is hereby <br />empowered to do and perform all acts aud things so agreed to be <br />done and performed by it as aforesaid. <br />3. In the event of the installation of auy water service facilities <br />and electrical generating machinery and equipment or water service <br />facilities or clectrical generating machinery and equipment pursuant <br />to a request therefor by the commission, the fllith and credit of the <br />State of Nevada hereby is and shall be irrevocably pledged for the <br />performance and observance of all covenants, conditions, limita- <br />tions, promises and undertakings made or specified to be kept, <br />observed or fulfilled on the part of this state, in any contract here- <br />tofore or hereafter entered into with the United States of America. <br />[7:71:1935; added 1947, 444; A 1951, 235]-(NRS A 1957, <br />66; 1963,744; 1964,5; 1965,40'6) <br /> <br />538.230 Hearings; attendance Qf witneS<les; oaths. <br />1. The commission shall have power: <br />(a) To hold heariugs. <br />(b) To receive and hear objections filed to the granting of con- <br />tracts after advertisement. <br />(c) To rcquire the attendance of witnesses. <br />(d) To take testimony whenever it shall deem it necessary to carry <br />out the provisions of NRS 538.0'40' to 538.260', inclusive. <br />2.
