<br />32 REPORT OF COLORADO RIVER COMMISSION OF NEVADA <br /> <br />8. To report to the governor such mcasures and legislative action <br />as may bc deemed necessary to secure to the people of Nevada all <br />possible benefits from the water of the Colorado River allocated to <br />or contracted by the State of Nevada and the power allocated to or <br />contracted by the State of Nevada to be generated at Hoover Dam <br />or elsewhere within the Colorado Rivcr stream system or from any <br />private or federal power development upon other rivers in the west. <br />ern United States for use in the State of Nevada. <br />9. To cooperate with and to establish, conduct and mainta.in, in <br />conjunction with other states or federal agencies, power, water and <br />irrigation projects. <br />[Part 7:71:1935; A 1943, 209; 1947,738; 1943 NCL S 1443.07]- <br />(NRS A 1965, 404) <br /> <br />538.170 Commission to receive, safeguard water, w,ater rights and <br />power of Colorado Rive.-. <br />1. 'l'he commission is empowered to receive, protect and safe- <br />guard and hold in trust for the State of Nevada all water and water <br />rights, and all other rights, interests or benefits in and to the waters <br />. of the Colorado River and to the power generated thereon now held <br />by or which may hereafter accrue to the State of Nevada under and <br />by virtue of any Act of the Congress of the United States or any <br />compacts or treaties between statcs to which the Sta.te of Nevada <br />may become a party, or otherwise. <br />2. Applications to appropriate such waters shall be made in <br />accordance with chapter 533 of NRS and sh.all he subject to approval <br />by the commission as set forth in NRS 533.370. <br />[Part 7:71:1935; A 1943, 209; 1947,738; 1943 NCL S 1443m]- <br />(NRS A 1959, 555; 1965, 405) <br /> <br />538.180 Leases, s,ales and contracts of power and water by com. <br />mission: Procedure; notice and hearing; applicant's bond. <br />1. The commission shall hold and administer all rights and bene. <br />fits pertaining to the distribution of the power and water mentioned <br />in NRS 538.040 to 538.260, inclusive, for the Sta.te of Nevada, and <br />is empowered to lease, sublease, let; sublet, contract or sell the same <br />on such terms as the commission sh-all determine. <br />2. Every applicant, except a federal or s.tate agency or political <br />subdivision, for power or water to be used within the State of <br />Nevada shall, before the application is approved, provide an indem. <br />nifying bond by a corporation qualified under the laws of this state, <br />or other collateral, approved by the state board of examiners, pay. <br />able to the Sta.te of Nevada in such sum and in such manner as <br />the commission may require, conditioned for the full and faithful <br />performance of such lease, sublease, contract or other agreement. <br />3. The power and water shall not be sold for less than the actual <br />cost to the State of Nevada. <br />4. Before any such sale or lease is made, the same shall be adver. <br />tised in two papers of general cireulation published in the State of <br />Nevada for a period of once a week for 2 weeks; and the commission <br />shall require any person desiring to make objection thereto to file the <br />objection with the secretary of the commission within 10 days after <br />the date of the last publication of the notice. If any objection shall <br />be filed pursuant to such notice then the commission shall set a time <br />and place for a hearing of the objection not more than 30 days after <br />the date of the last publication of the notice. <br />
