TERMS AND RESTRICTIONS <br /> <br />The term of this license begins upon acceptance of the <br />Software by the Colorado River Water Conservation District as <br />described in the Engineering Services Contract. <br /> <br />This license specifically prohibits the use of the Software for <br />any purposes other than the analysis of new developments, alternative <br />hydrology and demands, and modifications to water system operating <br />procedures in the Gunnison River Basin. <br /> <br />Licensee may duplicate and distribute copies of the Software <br />and accompanying written materials to others as Sub-Licensees. At <br />the end of each calendar month following the date this Software <br />License Agreement becomes effective, Licensee will provide <br />Hydrosphere with a list of all new Sub-Licensees. The distribution of <br />copies will be pursuant to a separate sub-licensing agreement, and the <br />cost of each sub-license will be limited to the cost of reproduction of <br />the materials. <br /> <br />. <br /> <br />Licensee and its Sub-Licensees own the magnetic or other <br />physical medium on which the Software is originally or subsequendy <br />recorded or fixed, but Hydrosphere retains tide and ownership of the <br />Software recorded on the original disk copy(ies) and all subsequent <br />copies of the Software, regardless of the form or media in or on which <br />the original and other copies may exist. This License is not a sale of <br />the original Software or any copy. <br /> <br />Licensee and its Sub-Licensees may each maintain one copy of <br />the Software on a removable medium disk for an archive or backup <br />and may maintain in addition one copy of the Software on fixed- <br />medium disks for day-to-day use. This permission to copy is for the <br />sole purpose of backing-up the Software and protecting it against <br />inadvertent loss. <br /> <br />Licensee and its Sub-Licensees are each entided to use theISoftware on multiple computers at the same time, so long as those <br />computers are within the exclusive control of Licensee or Sub- <br />Licensee. <br /> <br />. <br />
