S.B. 96-167 Depredatina animals - control bv commissioner of aoriculture.
Grants exclusi~e jurisdiction over the control of depredating animals to the
commissioner o~ agriculture. Allows the commissioner to:
. Adopt rules for the control of depredating animals in consultation
with ithe wildlife commission;
. Establish methods of controlling depredating animals, whether
lethal or nonlethal;
. Allo~ owners of agricultural products or resources and their agents
or d~signeesto control depredating animals; and
. AlloW! nonlethal methods of control or preventive activities..

Requires the commissioner, when promulgating rules, to obtain the prior
approval of th~ state agricultural commission and to consider and encourage
, ,
humane and effect~ve methods of control.

Includes $pecific provisions concerning the control of depredating
animals of at-r~sk species as follows:
. Requires the wildlife commission to preapprove any rules concerning
the taking of such animals;
. Requires the commissioner of agriculture to consider any reasonably
workaple alternative designed to minimize the direct effect on such
animals;
. Prohipits the commissioner from controlling such animals unless
damage is occurring; and
. Requit:'es the commissioner to notify the division of wildlife before
controlling such animals.

Authorizes: the commissioner to contract with the division of wildlife
for financial and other assistance.

S. B. 96-170 Severance tax trust fund - distributions - appropriation.
Authorizes the use of severance tax trust fund moneys for funding programs
that promote and encourage sound natural resource planning, management, and
development. Splits the severance tax trust fund into the perpetual base
account and the !operational account. Requires one-half of the severance tax
receipts credit$d to the fund for tax years commencing on and after January
1, 1995, to be credited to the operational account for funding such programs.
