Req~ires the state minerals, energy, and geology policy advisory <br />board to review the executive director's list of recommended programs before <br />submittal. <br /> <br />Allows the general assembly to appropriate money from the operational <br />account of the severance tax trust fund to the department of natural <br />resources foridistribution to selected programs or projects as follows: Up <br />to 45% of the moneys for programs within the Colorado oil and gas <br />conservation ~ommissioni up to 20% of the moneys for programs within the <br />Colorado geolqgical surveYi up to 30% of the moneys for programs within the <br />division of m~nerals and geologyi and up to 5% of the moneys for programs <br />within the Colorado water conservation board. Except in emergencies, limits <br />the use of moneys appropriated for programs and abandonment programs, well- <br />site reclamattion projects, and specific regulatory and environmental <br />,programs. Requires the commission to give priority to uses that reduce <br />industry fees 'and mill levies. <br /> <br />Appropriates $3,172,000 from the fund and 2.0 FTE to the department of <br />natural resources to fund specific programs for the fiscal year beginning <br />July 1, 1996. <br /> <br />APPROVED by Governor May 23, 1996 <br /> <br />EFFECTIVE May 23, 1996 <br /> <br />S.B. 96-212 Public records - ooen meetinas - use of electronic mail - <br />orivacv interests retention of records reauests for oublic access. <br />Declares that ' the use of electronic mail by government agencies creates <br />unique circum~tances that require a balancing of the privacy interests and <br />practical limitations of public officials and employees with the public <br />policy interests in access to government information. <br /> <br />Defines GIs "work product" not subj ect to public disclosure certain <br />advisory or d;eliberative materials assembled for the benefit of elected <br />officials, including notes and memoranda representing background material for <br />decisions, pre~iminary drafts and discussion copies of documents that express <br />decisions, and drafts, some reports, and some other materials relating to <br />legislative bills or amendments not yet introduced. <br /> <br />If elected; officials use e-mail to discuss pending legislation or other <br />public busines~ among themselves, makes such e-mail subject to existing open <br />meetings laws.' States that e-mail communication among elected officials that <br />does not relate to pending legislation or other public business shall not be <br />construed to be a "meeting". <br /> <br />Includes the correspondence of elected officials in the definition of a <br />"public record," subject to exceptions for items not connected to the <br />exercise of public functions or the expenditure of public money and form <br />communications' to or from constituents that are clearly intended to remain <br />
