It shauld be painted aut that Tiptan did not accept Senatar Downey's

argument that the water would be unusable. He stated that it wauld be usable.

Thi,s was also. the statement of John R. Riter who testified on the quantities

of return flaw (See p. 356).

8. Senatar Downey questioned Mr. Lawsan when he returned to. the

stand an the quality problem at page 944. Lawson's position was:

(a) the water to be delivered from the All-American Canal could
modify other flow sa that the water wauld be usable.

(b) the treaty does not cantain any implied guaranty of usebie
water.

9. Mr. Tipton returned to the stand to testify for the treaty, and

during his testimany at pages 1282-3 made the fallowing explanatian af the

rea sans behind the scheduling provisian:

"One such item which is majar in character is the schedule
which is set up in the treaty, in arder that the United States may
receive credit far the majar partian if nat all af the return flaw
that will reach the stream below the last paint af diversian in
the United States. There is very little use af water in Mexico. during the
winter period. Nir. Dowd testified, and I agree, that the present
use by Mexico. of water is such that abaut 19 to 20 percent af
its total use is mude in the month af maximum use. During the
wintertime the use may drap dawn to. 1 percent of the total
seasonal use. On the other hand, the use by the Imperial irri-
gation district is such that in the month of maximum use anly
abaut 10 percent of the total annual amount is used, and the
minimum is 5 percent dunng the manth of minimum requirement.

B 14
