sa as to. deliver water to Mexico. that was sa saline as to. be
tatally' useless to. Mexico., Mexico. wauld have to. take that,
under the treaty?
"Mr. TIPTON. That is my awn apinian, sir; but I want
to. paint aut again that while that was the intent af the language
af the treaty, I am nat an attarney. There will be witnesses
far the Six State Cammittee who. are attarneys and can probably
go. into. that further with yau fram the legal stand paint . I can-
nat, sir; I can anly tell yau what the intent was.
"Senatar DOWNEY. But yau have already tald us that
there are dacuments signed by the Mexican Gavernment in
which they agree to. take water regardless af its quality.
"Mr. TIPTON. No., sir; I did nat make any such statement.
"Senatar DOWNEY. What was it, then?
"Mr. TIPTON. I tald you that there was a pas sage af mema-
randa between the negatiators which indicated what aur intent
was, and the language was finally written araund that. There was
nathing signed.
"Senatar DOWNEY. It was a memarandum an aur part?
"Mr. TIPTON. Yes, sir.
"Senatar DOWNEY. Sa far as yau knaw, is there any
memarandum an the part af the Gavernment af Mexico. stating
that it will take water which is nat usable?
"Mr. TIPTON. Senatar, yau are assuming that this water
is nat usable. I am nat assuming that it will nat be usable, and
neither were the Mexican negatiatars. I think yau are making
an assumptian which is nat true.
"Senatar DOWNEY. I understaad yau this marning to. say
that there had been memaranda signed by both Gavernments.
. __ __ ___~Mr ~IPTON. I did not mean to. canvey that impressian.
I meant that there were memoranda passed from the American
negatiatars to. the Mexican negatiatars indicating plainly what
the intent af the American negatiatars was; and there was nat
anly ane; there were several. As a result af that the American
demands were accepted and there was written into. the treaty
the present language which is suppased to. caver the situatian.
Whether it daes ar whether it daes nat is a questian af inter-
pretatian af language and a questian af legal interpretatian af
language. But the language is there to express an intent, and
I knaw what the intent was.
"Senatar DOWNEY. On the part af the United States?
"Mr. TIPTON. On the part af the Mexican negatiatars.
"Senatar DOWNEY. Is the intent an the part af the Mexican
negatiatars expressed in writing?
"Mr. TIPTON. I do. nat knaw, sir; but I am just telling yau
that as ane af the negatiatars, whether it was in writing ar nat,
it was understaod."

B 13
