<br />('..1 <br />~ <br />c.:') <br /> <br />~~ <br />o <br />(~ <br /> <br />I. INTRODUCTION <br /> <br />The Colorado River Basin Salinity Control Act, 43 U.S.C. <br /> <br />~ 1571, et~. (Salinity Control Act) authorizes and directs the <br /> <br />Secretary of the Interior to implement the Salinity Control <br /> <br />Policy adopted for the Colorado River by means of the <br /> <br />construction, operation and maintenance of salinity control units <br /> <br />upstream from the Imperial Dam. The Grand Valley Unit is a unit <br /> <br />designated under the Salinity Control Act. <br /> <br />Salinity control <br /> <br />measures <br /> <br />for <br /> <br />the Grand Valley Unit <br />laterall irrigation <br /> <br />primarily <br /> <br />the <br /> <br />consist <br /> <br />of <br /> <br />lining <br /> <br />ditches to <br /> <br />salt <br /> <br />reduce <br /> <br />of <br /> <br />contributions to the Colorado River. <br /> <br />Prior to undertaking <br /> <br />construction of the Grand Valley Unit, the Secretary of the <br /> <br />Interior is directed to enter into contracts with non-Federal <br /> <br />entities for the long-term operation and maintenance of improved <br /> <br />lateral ditches. <br /> <br />In addition, though not specifically mentioned <br /> <br />in the Salinity Control Act, there has been discussion that the <br /> <br />contracting non-Federal entities also undertake the construction <br /> <br />of the improvements to the lateral ditches. <br /> <br />The Secretary of the Interior, acting through the Bureau of <br /> <br />Reclamation, in concert with the State of Colorado Department of <br /> <br />1 <br />As a matter of information, Colorado has defined a <br />"lateral" ditch to be a branch ditch which has its headgate in <br />the main ditch and not in a natural water course. New Mul ta <br />Trina Ditch Co. v. putch, 123 Colo. 444, 230 P.2d 597 (1951). <br />This definition is not the same as is being used by the Bureau in <br />its description of salinity control measures. <br />
