On June 10, 1985, William G. <br /> <br />Waldeck, <br /> <br />Esquire, <br /> <br />furnished <br /> <br />his <br /> <br />regarding <br /> <br />formal <br /> <br />report <br /> <br />organizations (Waldeck Report) and identified six essential <br />qualities2 a non-Federal entity must have in order to be able to <br /> <br />undertake salinity control measures. The Grand Valley Irrigation <br /> <br />Company (Company) was one of the entities identified in the <br /> <br />Waldeck Report as having potential to serve as a contracting <br /> <br />non-Federal entity. <br /> <br />The Company has expressed an interest in <br /> <br />providing such service. <br /> <br />On September 8, 1986, the State of Colorado, acting through <br /> <br />its Water Conservation Board, contracted with the general counsel <br /> <br />for the Company, Nelson, Hoskin, Groves & Prinster, Professional <br /> <br />Corporation, for the purpose of conducting a legal review of the <br /> <br />applicable organizational statutory authority and Articles of <br /> <br />Incorporation, <br /> <br />organizational <br /> <br />Bylaws <br /> <br />and <br /> <br />other <br /> <br />pertinent: <br /> <br />documents of the Company to determine if the Company had the <br /> <br />legal authority and power to acquire real property interests in <br /> <br />the lateral ditches under its system and do such other things as <br /> <br />2 Perpetual existence, small aerial jurisdiction, authority <br />to assess charges, power to obtain necessary property rights by <br />eminent domain, authority to regulate water users, and authority <br />to comply with the Salinity Control Act. <br /> <br />2 <br />
