The Act further provides: <br /> <br />For the purposes of defraying the expenses of the <br />organization of the district, and the care, operation, <br />management, repair, and improvement of all canals, <br />ditches, reservoirs, and works, including salaries of <br />officers and employees, the board may either fix rates <br />of tolls and charges and collect the same of all persons <br />using said canal and water for irrigation or other <br />purposes, and in addition thereto may provide, in whole <br />or in part, for the payment of such expenditures by levy <br />of assessment therefore, as provided ire. Section <br />37-42-126, or by both tolls and assessments. Section <br />37-42-131(2), C.R.S; See also 37-43-141, C.R.S. <br /> <br />An irrigation district (under the 1921 Act) is formed by the <br /> <br />following procedures: <br /> <br />(a) A Petition is made to the County Commissioners of <br /> <br />the county in which the district lands are situated <br /> <br />signed by a majority of the landovmers, whether or <br /> <br />not residents, of the proposed district, owning, in <br /> <br />the aggregate, a majority of the acreage of the <br /> <br />area. 37-42-101, C.R.S. <br /> <br />(b) A hearing is held on the petition and, if in order, <br /> <br />an election is called to submit the question of <br /> <br />creation of the district to the electorate. <br /> <br />37-42-102, C.R.S. 1973. <br /> <br />(c) An election is held to determine whether the <br /> <br />proposed district shall be organized and, if <br /> <br />organized, for the election of it" officers. At the <br /> <br />election, every owner of agricultural land in the <br /> <br />district over the age of 21 years who is a citizen <br /> <br />of the United States or is a resident and has paid <br /> <br />-31- <br />
