Section 37-42-113(2), C.R.S. <br /> <br />An irrigation district may contract with the United States for <br /> <br />the construction or operation and maintenance of necessary works <br /> <br />for delivery of water. Section 37-42-113(3), C.R.S. The district <br /> <br />may "contract with the United States for a water supply under act <br /> <br />of Congress providing for or permitting such contract, and may <br /> <br />convey to the United States as partial or full consideration <br /> <br />therefore water rights or other property of the district." <br /> <br />Section 37-42-113(3), C.R.S. Another Section of the 1921 Act <br /> <br />provides that title to property acquired by the district shall <br /> <br />vest in the irrigation district in its corporate name "and shall <br /> <br />be held in trust for, and is hereby dedicated and set apart for, <br /> <br />the uses and purposes provided for in this article." 37-42-113, <br /> <br />C.R.S. One of such purposes is "to cooperate wi-th the United <br /> <br />States under the federal reclamation laws or any other federal <br /> <br />laws enacted by the Congress of the United States for the purpose <br /> <br />of construction of irrigation works..." 37-42-110, C.R.S. <br /> <br />In our opinion, the above provisions are broad enough to <br /> <br />empower an Irrigation District to obtain rights of way for the <br /> <br />Lateral pipelines and convey such rights of way to the United <br /> <br />States for construction of the Grand Valley Unit. <br /> <br />The 1921 Act provides for the assessment and levy of taxes <br /> <br />against the lands within the district in order to meet the <br /> <br />-30- <br />
