Although both the 1905 Act and the 1921 Act were <br /> <br />supplemented by legislation in 1935 (37-43-101, C.R.S.), if a new <br /> <br />irrigation district were to be organized today, it would be under <br /> <br />the provisions of the 1921 Act. Section 37-42-140, C.R.S. <br /> <br />Therefore, the fOllowing discussion will be directed to the 1921 <br /> <br />Act as subsequently amended and supplemented. <br /> <br />The power of eminent domain is granted to acquire property or <br /> <br />rights of any kind, including rights-of-way for all or part of any <br /> <br />projected, partly completed system of irrigation or water works or <br /> <br />any other property or right necessary or useful for carrying out <br /> <br />the objects of the district. 37-42-113, C.R.S. 1973.
