The parties also agree that implementation ofP.L. 93-638 in the manner <br />set forth herein shall allow for efficient and effective administration ofthese design and <br />construction contracts. By entering into this Master Contract both parties agree to conduct the <br />construction of A-LP as set forth in this document. <br /> <br />Each provision of the Act, this Master Contract, and each provision of subsequently awarded <br />Contracts for the individual project features shall be liberally con8trued for the benefit of the <br />Contractor to transfer the funding and the following related construction services and activities <br />(or portions thereof), that are otherwise contractible under section 102(a) of such Act (25 U.S.C. <br />450f), as identified in a division of work Resolution of the Ute Mountain Ute Tribe and the <br />Southern Ute Indian Tribe, from Reclamation to the Contractor: <br /> <br />The Contractor will be performing the construction of the Ridges Basin Dam and Reservoir, <br />Durango Pumping Plant, the Inlet Conduit, and appurtenant facilities which permit an average <br />annual depletion of 57,000 acre-feet of water to be used for municipal and industrial water <br />supply. <br /> <br />This Master Contract will set forth provision8, terms, and conditions that will apply to all future <br />Construction Contracts for the individual project features and will be incorporated into each <br />Construction Contract. <br /> <br />Nothing in this Contract or subsequent Contracts may be construed to terminate, waive, modifY <br />or reduce the trust responsibility of the United States to the tribe or individual Indians. The <br />Bureau of Reclamation, for and on behalf ofthe Secretary, shall act in good faith in upholding <br />such trust responsibility. <br /> <br />The Resolutions of the Ute Mountain Ute Tribe and the Southern Ute Indian Tribe authorizing <br />the divisibility of the functions and activities identified in this Contract are attached to this <br />Contract as attachments I and 2. The Resolution of the Ute Mountain Ute Tribe approving this <br />Contract is included as attachment 3. <br /> <br />2 <br />
