<br />002085 <br /> <br />MASTER CONTRACT OF GENERAL PROVISIONS FOR <br />SELF-DETERMINATION CONSTRUCTION CONTRACTS <br />between the <br />Department of the Interior, Bureau of Reclamation <br />and the <br />Ute Mountain Ute Tribe <br /> <br />PART I - AUTHORITY AND PURPOSE <br /> <br />A. Authority. This Self-Determination Master Contract (hereinafter referred to as the <br />"Contract") is entered into by the U.S. Department of the Interior, Bureau of Reclamation, for <br />and on behalf of the Secretary of the Interior (referred to in this Contract as "Reclamation") <br />pursuant to Public Law 100-585, Colorado Ute Indian Water Rights Settlement Act of 1988, <br />Public Law 106-554, Colorado Ute Settlement Act Amendments of2000, and Title I of the <br />Indian Self-Determination and Education Assistance Act (hereinafter referred to as the "Act") <br />and by the Ute Mountain Ute Tribe (hereinafter referred to as the "Tribe") pursuant to the terms <br />specified in Resolution No. 2002-164 and by entering into this Contract further authorizes <br />Weeminuche Construction Authority (referred to in this Contract as the "Contractor") to exercise <br />the rights and obligations specified in this Contract and the subsequent individual Construction <br />Contracts. <br /> <br />B. Purpose. By operation ofP.L. 100-585, the Colorado Ute Indian Water Rights <br />Settlement Act, Congress determined that the design and construction functions ofthe Animas- <br />La Plata Project (A-LP) shall be subject to the provisions of the Indian Self-Determination and <br />Education Assistance Act, P.L. 93-638. All parties agree that construction of A-LP constitutes a <br />"program" as that term is in 93-638 (i.e. program, service, function or activity) and its <br />implementing regulations. Given that construction of A-LP is comprised of several component <br />parts, both parties agree that the form of relationship between Reclamation and the Tribe for <br />construction of the entire A-LP Project should be comprised of a Master Contract and contracts <br />issued under the Master Contract for certain specific tasks. <br /> <br />Consequently, the form of this document is a Master Contract. It specifies the rights and <br />obligations of each party for the overall development and construction of the A-LP and that the <br />parties will agree to enter into separate contracts which collectively will comprise the entire <br />construction of A-LP (these tasks are set forth in Part n, Section I ofthis agreement). To the <br />extent that terms in the specific contracts are inconsistent with the master agreement, the <br />provisions of the master agreement shall control. <br /> <br />The parties agree that this plan is appropriate given the complexities involved with the <br /> <br />I <br />
