<br />002109 <br /> <br />B. Contract Modifications. <br /> <br />I. All contract modifications and additions shall be in writing by using a Standard Form <br />30, Amendment of Solicitation/Modification of Contract, and signed by both Reclamation and <br />the Contractor. <br /> <br />2. Change Orders. Due to the nature of construction, there may be instances where <br />Reclamation will need to make changes to the work within the general scope of a contract for an <br />individual project feature by issuing a unilateral construction "change order." Such changes shall <br />be made following consultation with the Contractor and in accordance with FAR 52.243-4 <br />(Changes). <br /> <br />3. Administrative Changes. Reclamation's Contracting Officer may issue a unilateral <br />contract change that does not affect the substantive rights of the parties (e.g. a change in the <br />paying office or the appropriation data) provided proper notice is given to the Contractor. <br /> <br />C. Order of Precedence. Any inconsistency in a Construction Contract for an individual <br />proj ect feature shall be resolved by giving precedence in the following order: <br /> <br />( <br /> <br />I. Contract clauses and provisions; <br />2. Other documents, exhibits, and attachments, excluding the specifications and drawings; <br />3. The specifications; and <br />4. The drawings. <br /> <br />D. Dispute Resolution. This Contract, and all Construction Contracts for the individual <br />project features, and all subcontracts involving an interest of Reclamation shall be subject to <br />section 110 of the Act (25 V.S.C. 45Om-I), 25 CFR Part 900 Subpart N. The parties pledge to <br />pursue resolution of dispute issues through informal discussions and/or use of the Disputes <br />Review Board process described in Attachment 4, prior to filing a Contract Disputes Act claim <br />utilizing the guidelines set forth in FAR 52.233-1. <br /> <br />E. Resolution of Disputes Between Contractor and Its Subcontractors. With respect to <br />disputes between the Contractor and subcontractors not involving an interest of Reclamation, the <br />Contractor will insert in its subcontracts appropriate language establishing a dispute resolution <br />process. <br /> <br />F. Officials Not to Benefit. No member of Congress, or resident commissioner, shall be <br />admitted to any share or part of any contract executed pursuant to this Contract or Construction <br />Contracts for the individual project features, or to any benefit that may arise from such contract. <br />Construction contracts for the individual project features may not be construed to apply to any <br />subcontract with a third party entered into under a Construction Contracts for the individual <br />project features if such subcontract is made with a corporation for the general benefit of the <br />corporation. <br /> <br />25 <br />
