<br />002110 <br /> <br />G. Covenant Against Contingent Fees. The parties warrant that no person or selling agency <br />has been employed or retained to solicit or secure any contract executed pursuant to each <br />Construction Contract for the individual project features upon an agreement or understanding for <br />a commission, percentage, brokerage, or contingent fee, excepting bona fide employees or bona <br />fide established commercial or selling agencies maintained by the Contractor for the purpose of <br />securing business. <br /> <br />H. Insurance and Indemnification. <br /> <br />1. The Contractor shall secure within five (5) calendar days of the award of a <br />Construction Contract for an individual project feature, pay premiums for, and keep in force until <br />the expiration of that Contract or any renewal period thereof, insurance as provided below. Such <br />insurance policies shall specifically include a provision stating the liability assumed by the <br />Contractor under this Contract, and shall name the United States as an additional insured. If, <br />after award of the Contract, the Contractor fails to obtain sufficient insurance coverage, <br />Reclamation may notify the Contractor by letter if it decides to procure specific insurance <br />policies for the Contractor to be used for coverage under the terms of this Contract. In either <br />case, such insurance may include: <br /> <br />(a) Workman's compensation insurance as required by laws of the various States <br />in which the agreement is performed; <br /> <br />(b) Owner's, landlord's and tenant's bodily injury liability insurance with limits of <br />not less that $50,000 for each person and $500,000 for each accident; <br /> <br />( <br /> <br />(c) Property damage liability insurance with limits of not less than $25,000 for <br />each accident; <br /> <br />(d) Automobile bodily injury liability insurance with limits on personal injury <br />liability of not less than $50,000 for each person and $500,000 for each accident, and <br />automobile property damage liability insurance with a limit of not less than $5,000 for <br />each accident; and <br /> <br />(e) Other insurance not specifically mentioned when required by law or other <br />regulations. <br /> <br />(f) The amounts shown in subparts (b) and (c) above are minimums. These <br />amounts will be adjusted, as negotiated, for each contract for the individual project <br />features. <br /> <br />2. Each policy of insurance shall contain an endorsement providing that cancellation by <br />the insurance company shall not be effective unless a copy of the cancellation is mailed <br />(registered) to Reclamation at least thirty (30) days before the effective date of cancellation. <br /> <br />26 <br />
