<br />0021J5 <br /> <br />7. Subcontract Provisions. The Contractor shall use its own procurement system and <br />procedures to ensure that each subcontract includes clauses required by Federal statutes and <br />executive orders and their implementing regulations, and state and local laws and regulations. <br />Subcontracts should contain a provision informing the subcontractor that its award is funded with <br />Federal funds and that the subcontractor is responsible for identifYing and ensuring compliance <br />with applicable Federal laws, regulations, and executive orders, including but not limited to: <br /> <br />(a) Compliance with the Copeland "Anti-Kickback" Act as supplemented by <br />Department of Labor regulations; <br /> <br />(b) Compliance with the Davis-Bacon Act as supplemented by Department of <br />Labor regulations; <br /> <br />(c) Compliance with Sections 103 and 107 of the Contract Work Hours and <br />Safety Standards Act as supplemented by Department of Labor regulations; <br /> <br />(d) Compliance with Miller Act with regard to performance and payment bonds; <br /> <br />( e) Compliance with all applicable standards, orders, or requirements issued <br />under Section 306 of the Clean Air Act; as amended; Section 508 of the Clean Water Act, <br />Executive Order 11738, and Environmental Protection Agency regulations; <br /> <br />( <br /> <br />(f) Mandatory standards and policies relating to energy efficiency which are <br />contained in the state energy conservation plan issued in compliance with the Energy <br />Policy and Conservation Act; <br /> <br />(g) Compliance with Federal Standard No. 313 (including revisions adopted <br />during the term of the Contract) with regard to Hazardous Material Identification and <br />Material Safety Data; <br /> <br />(h) Compliance with the National Environmental Policy Act and the National <br />Historic Preservation Act and all other related environmental and cultural resource laws <br />and regulations as they apply to this project; <br /> <br />(i) To the greatest extent practicable, ensure that all equipment and products <br />purchased with Contract funds are American-made; <br /> <br />G) Retention of all required records for three (3) years after final payment and all <br />other pending matters are closed; and <br /> <br />(k) Warranty that delivery of items or work required will be free of asbestos in <br />any form whatsoever except for the use of asbestos cement pipe. <br /> <br />21 <br />
